| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 6.15, Texas Racing Act (Article 179e, |
|---|
| 11 | 11 | | Vernon's Texas Civil Statutes), is amended to read as follows: |

| 12 | 12 | | Sec. 6.15. RACING AT TEMPORARY LOCATION. After an |
|---|
| 13 | 13 | | association has been granted a license to operate a racetrack and |
|---|
| 14 | 14 | | before the completion of construction at the designated place for |
|---|
| 15 | 15 | | which the license was issued, the commission may, on application by |
|---|
| 16 | 16 | | the association, issue a temporary license that permits the |
|---|
| 17 | 17 | | association to conduct races at a location in the same county for a |
|---|
| 18 | 18 | | period expiring six [two] years after the date of issuance of the |
|---|
| 19 | 19 | | temporary license or on the completion of the permanent facility, |
|---|
| 20 | 20 | | whichever occurs first. The commission may set the conditions and |
|---|
| 21 | 21 | | standards for issuance of a temporary license and allocation of |
|---|
| 22 | 22 | | appropriate race days. An applicant for a temporary license must |
|---|
| 23 | 23 | | pay the application fees and must post the bonds required of other |
|---|
| 24 | 24 | | licensees before the issuance of a temporary license. After a |
|---|
| 25 | 25 | | temporary license has expired, no individual, corporation, or |
|---|
| 26 | 26 | | association, nor any individual belonging to a corporation or |
|---|
| 27 | 27 | | association which has been granted a temporary license, may get an |
|---|
| 28 | 28 | | extension of the temporary license or a new temporary license. |

| 29 | 29 | | SECTION 2. The Texas Racing Commission shall grant an |
|---|
| 30 | 30 | | extension of up to four years for any association currently in |
|---|
| 31 | 31 | | possession of an unexpired temporary license as described in |
|---|
| 32 | 32 | | Section 1 of this Act. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2013. |
