77 relating to water well drillers and pump installers; changing fees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1901.001, Occupations Code, is amended
1010 by adding Subdivision (13-a) and amending Subdivision (16) to read
1111 as follows:
1212 (13-a) "Third-party inspector" means a qualified
1313 employee of a state agency with jurisdiction over wells, or a
1414 qualified employee of a groundwater conservation district, who
1515 assists the department with enforcement activities.
1616 (16) "Well" means a water well, injection well,
1717 dewatering well, closed-loop geothermal well, or monitoring well.
1818 SECTION 2. Subchapter B, Chapter 1901, Occupations Code, is
1919 amended by adding Section 1901.056 to read as follows:
2020 Sec. 1901.056. REGIONAL WELL INSPECTION PROGRAM. (a) The
2121 commission by rule shall establish a regional well inspection
2222 program using third-party inspectors.
2323 (b) Rules adopted under Subsection (a) shall establish:
2424 (1) training requirements for a third-party
2525 inspector;
2626 (2) registration procedures for a third-party
2727 inspector; and
2828 (3) policies governing the acts of a third-party
2929 inspector in conducting an inspection or investigation.
3030 SECTION 3. Section 1901.152, Occupations Code, is amended
3131 to read as follows:
3232 Sec. 1901.152. LICENSE APPLICATION[; EXAMINATION FEE].
3333 [(a)] An applicant [application] for a license must submit to the
3434 department [contain]:
3535 (1) an application that includes:
3636 (A) the applicant's name;
3737 (B) [(2)] the applicant's business address;
3838 (C) [(3)] the applicant's permanent mailing
3939 address; and
4040 (D) [(4)] any other relevant information
4141 required by the department; and[.]
4242 (2) [(b) An applicant must pay to the department] an
4343 application [examination] fee [at the time the application is
4444 submitted].
4545 SECTION 4. Subchapter D, Chapter 1901, Occupations Code, is
4646 amended by adding Section 1901.153 to read as follows:
4747 Sec. 1901.153. APPRENTICE DRILLER PROGRAM. The commission
4848 by rule shall establish an apprentice driller program.
4949 SECTION 5. Subsection (a), Section 1901.201, Occupations
5050 Code, is amended to read as follows:
5151 (a) The department shall offer examinations for a license
5252 under this chapter [at least once each year].
5353 SECTION 6. Subsection (a), Section 1901.251, Occupations
5454 Code, is amended to read as follows:
5555 (a) Each driller who drills, deepens, or otherwise alters a
5656 [water] well in this state shall make and keep a legible and
5757 accurate well log in accordance with rules adopted by the
5858 commission and on forms prescribed by the executive director. The
5959 well log shall be recorded at the time of drilling, deepening, or
6060 otherwise altering the well and must contain:
6161 (1) the depth, thickness, and character of the strata
6262 penetrated;
6363 (2) the location of water-bearing strata;
6464 (3) the depth, size, and character of casing
6565 installed; and
6666 (4) any other information required by rules adopted by
6767 the commission.
6868 SECTION 7. Subchapter I, Chapter 1901, Occupations Code, is
6969 amended by adding Section 1901.405 to read as follows:
7070 Sec. 1901.405. THIRD-PARTY INSPECTORS; ENFORCEMENT. The
7171 department may contract with a third-party inspector to assist in
7272 the enforcement of this chapter or a rule adopted under this
7373 chapter, including rules governing the performance of inspections
7474 and the conduct of investigations.
7575 SECTION 8. Section 1902.001, Occupations Code, is amended
7676 by adding Subdivision (8-a) to read as follows:
7777 (8-a) "Third-party inspector" means a qualified

7979 qualified employee of a groundwater conservation district, who
8080 assists the department with enforcement activities.
8181 SECTION 9. Section 1902.152, Occupations Code, is amended
8282 to read as follows:
8383 Sec. 1902.152. LICENSE APPLICATION[; EXAMINATION FEE].
8484 [(a)] An applicant [application] for a license must submit to the
8585 department [contain]:
8686 (1) an application that includes:
8787 (A) the applicant's name;
8888 (B) [(2)] the applicant's business address;
8989 (C) [(3)] the applicant's permanent mailing

9696 SECTION 10. Subchapter D, Chapter 1902, Occupations Code,
9797 is amended by adding Section 1902.153 to read as follows:
9898 Sec. 1902.153. APPRENTICE PUMP INSTALLER PROGRAM. The
9999 commission by rule shall establish an apprentice pump installer

101101 SECTION 11. Subsection (a), Section 1902.201, Occupations
102102 Code, is amended to read as follows:
103103 (a) The department shall offer examinations for a license
104104 under this chapter [at least once each month].
105105 SECTION 12. Subchapter I, Chapter 1902, Occupations Code,
106106 is amended by adding Section 1902.405 to read as follows:
107107 Sec. 1902.405 THIRD-PARTY INSPECTORS; ENFORCEMENT. The
108108 department may contract with a third-party inspector to assist in
109109 the enforcement of this chapter or a rule adopted under this
110110 chapter, including rules governing the performance of inspections
111111 and the conduct of investigations.
112112 SECTION 13. The following provisions of the Occupations
113113 Code are repealed:
114114 (1) Subsection (b), Section 1901.201; and
115115 (2) Subsection (b), Section 1902.201.
116116 SECTION 14. Not later than April 1, 2014, the Texas
117117 Commission of Licensing and Regulation shall adopt rules to
118118 implement the changes in law made by this Act to Chapters 1901 and
119119 1902, Occupations Code.
120120 SECTION 15. This Act takes effect September 1, 2013.
