77 relating to the requirements for issuance of a license to practice
88 orthotics and prosthetics.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsections (b) and (c), Section 605.252,
1111 Occupations Code, are amended to read as follows:
1212 (b) The requirements for a license established by board rule
1313 must include the requirement that the applicant hold:
1414 (1) a bachelor's or graduate degree in orthotics and
1515 prosthetics from:
1616 (A) an education program recognized and
1717 accredited by the Commission on Accreditation of Allied Health
1818 Education Programs that is offered at an institution of higher
1919 education; or
2020 (B) a practitioner education program that has
2121 education standards that are equivalent to or exceed the standards
2222 adopted by the Commission on Accreditation of Allied Health
2323 Education Programs; or
2424 (2) a bachelor's degree in another subject and an
2525 orthotic or prosthetic certificate issued by a practitioner
2626 education program:
2727 (A) recognized and accredited by the Commission
2828 on Accreditation of Allied Health Education Programs; or
2929 (B) that has education standards that are
3030 equivalent to or exceed the standards adopted by the Commission on
3131 Accreditation of Allied Health Education Programs.
3232 (c) To meet the clinical residency requirements for a
3333 license, the applicant must complete a [at least 1,900 hours of]
3434 professional clinical residency that meets the requirements
3535 established by board rule and is conducted under the direct
3636 supervision of a licensed orthotist, licensed prosthetist, or a
3737 licensed prosthetist orthotist in the discipline for which
3838 licensure is sought. The clinical residency requirements adopted
3939 by the board must be equivalent to or exceed the standards set by
4040 the National Commission on Orthotic and Prosthetic Education.
4141 SECTION 2. Subsection (a), Section 605.258, Occupations
4242 Code, is amended to read as follows:
4343 (a) The board may issue a student registration certificate
4444 to an individual who is working toward fulfilling the requirements
4545 for a license as an orthotist, prosthetist, or prosthetist
4646 orthotist and:
4747 (1) holds either:
4848 (A) [(1)] a bachelor's or graduate degree in
4949 orthotics and prosthetics from:
5050 (i) [(A)] an education program recognized
5151 and accredited by the Commission on Accreditation of Allied Health
5252 Education Programs that is offered at an institution of higher
5353 education; or
5454 (ii) [(B)] a practitioner education
5555 program that has education standards that are equivalent to or
5656 exceed the standards adopted by the Commission on Accreditation of
5757 Allied Health Education Programs; or
5858 (B) [(2)] a bachelor's degree in another
5959 subject and an orthotic or prosthetic certificate issued by a
6060 practitioner education program:
6161 (i) [(A)] recognized and accredited by the
6262 Commission on Accreditation of Allied Health Education Programs; or
6363 (ii) [(B)] that has education standards
6464 that are equivalent to or exceed the standards adopted by the
6565 Commission on Accreditation of Allied Health Education Programs; or
6666 (2) is a student who:
6767 (A) is currently enrolled in a graduate program
6868 in this state in orthotics and prosthetics that:
6969 (i) is recognized and accredited by the
7070 Commission on Accreditation of Allied Health Education Programs;
7171 and
7272 (ii) incorporates a professional clinical
7373 residency that meets the requirements of rules adopted under
7474 Section 605.252(c); and
7575 (B) submits to the board a written certification
7676 from the graduate program in which the student is enrolled that the
7777 student has successfully completed the academic prerequisites to
7878 enter a professional clinical residency.
7979 SECTION 3. The changes in law made by this Act to Chapter
8080 605, Occupations Code, apply only to an application for a license or
8181 student registration certificate submitted to the Texas Board of
8282 Orthotics and Prosthetics on or after January 1, 2014. An
8383 application submitted before January 1, 2014, is governed by the
8484 law in effect immediately before the effective date of this Act, and
8585 the former law is continued in effect for that purpose.
8686 SECTION 4. The Texas Board of Orthotics and Prosthetics
8787 shall adopt rules to implement the changes in law made by this Act
8888 not later than December 1, 2013.
8989 SECTION 5. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2013.
