1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the exemption of the Corpus Christi Aquifer Storage and
1313 Recovery Conservation District from certain provisions concerning
1414 the desired future conditions of an aquifer.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 8811.005, Special District Local Laws
1717 Code, is amended to read as follows:
1818 Sec. 8811.005. APPLICABILITY OF OTHER LAW. (a) Except as
1919 otherwise provided by this chapter, Chapter 36, Water Code, applies
2020 to the district.
2121 (b) The following provisions of Chapter 36, Water Code, do
2222 not apply to the district:
2323 (1) Sections 36.063(b) and (c);
2424 (2) Sections 36.1071(a)(8) and (e)(3)(A);
2525 (3) Sections 36.108(c)(4), (d), (d-1), (d-2), (d-3),
2626 and (d-4);
2727 (4) Section 36.1083;
2828 (5) Section 36.1084;
2929 (6) Section 36.1085; and
3030 (7) Section 36.1132.
3131 (c) An affected person may not file a petition with the
3232 Texas Commission on Environmental Quality under Section 36.1082,
3333 Water Code, requesting an inquiry in connection with the district
3434 for a reason provided by Subsection (b)(4), (5), (6), or (7) of that
3535 section.
3636 (d) The Texas Commission on Environmental Quality may not
3737 take action against the district under Section 36.3011, Water Code,
3838 based on a finding under Subdivision (4), (5), (6), or (7) of that
3939 section.
4040 SECTION 2. The change in law made by this Act applies only
4141 to a petition filed under Section 36.1082 or 36.1083, Water Code, on
4242 or after the effective date of this Act. A petition filed before
4343 the effective date of this Act is governed by the law in effect when
4444 the petition was filed, and that law is continued in effect for that
4545 purpose.
4646 SECTION 3. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2013.
