| 15 | 15 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Section 8811.005, Special District Local Laws |
|---|
| 17 | 17 | | Code, is amended to read as follows: |
|---|
| 18 | 18 | | Sec. 8811.005. APPLICABILITY OF OTHER LAW. (a) Except as |
|---|
| 19 | 19 | | otherwise provided by this chapter, Chapter 36, Water Code, applies |
|---|
| 20 | 20 | | to the district. |
|---|
| 21 | 21 | | (b) The following provisions of Chapter 36, Water Code, do |
|---|
| 22 | 22 | | not apply to the district: |
|---|
| 23 | 23 | | (1) Sections 36.063(b) and (c); |
|---|
| 24 | 24 | | (2) Sections 36.1071(a)(8) and (e)(3)(A); |
|---|
| 25 | 25 | | (3) Sections 36.108(c)(4), (d), (d-1), (d-2), (d-3), |
|---|
| 26 | 26 | | and (d-4); |
|---|
| 27 | 27 | | (4) Section 36.1083; |
|---|
| 28 | 28 | | (5) Section 36.1084; |
|---|
| 29 | 29 | | (6) Section 36.1085; and |
|---|
| 30 | 30 | | (7) Section 36.1132. |
|---|
| 31 | 31 | | (c) An affected person may not file a petition with the |
|---|
| 32 | 32 | | Texas Commission on Environmental Quality under Section 36.1082, |
|---|
| 33 | 33 | | Water Code, requesting an inquiry in connection with the district |
|---|
| 34 | 34 | | for a reason provided by Subsection (b)(4), (5), (6), or (7) of that |
|---|
| 35 | 35 | | section. |
|---|
| 36 | 36 | | (d) The Texas Commission on Environmental Quality may not |
|---|
| 37 | 37 | | take action against the district under Section 36.3011, Water Code, |
|---|
| 38 | 38 | | based on a finding under Subdivision (4), (5), (6), or (7) of that |
|---|
| 39 | 39 | | section. |
|---|
| 40 | 40 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 41 | 41 | | to a petition filed under Section 36.1082 or 36.1083, Water Code, on |
|---|
| 42 | 42 | | or after the effective date of this Act. A petition filed before |
|---|
| 43 | 43 | | the effective date of this Act is governed by the law in effect when |
|---|
| 44 | 44 | | the petition was filed, and that law is continued in effect for that |
|---|
| 45 | 45 | | purpose. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2013. |
