77 relating to the provision of emergency services in the
88 Williamson-Travis Counties Water Control and Improvement District
99 No. 1G.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 9036 to read as follows:
1313 CHAPTER 9036. WILLIAMSON-TRAVIS COUNTIES WATER CONTROL AND
1414 IMPROVEMENT DISTRICT NO. 1G
1515 Sec. 9036.001. DEFINITION. In this chapter, "district"
1616 means the Williamson-Travis Counties Water Control and Improvement
1717 District No. 1G.
1818 Sec. 9036.002. REMOVAL OF AREA FROM EMERGENCY SERVICES
1919 DISTRICT. (a) This section applies only to:
2020 (1) a municipality with a population of less than
2121 100,000; and
2222 (2) an emergency services district operating under
2323 Chapter 775, Health and Safety Code, in which the district is wholly
2424 or partly located.
2525 (b) If the district enters into a strategic partnership
2626 agreement with a municipality under Section 43.0751, Local
2727 Government Code, that includes the provision of fire-fighting
2828 services as defined by Section 49.351(k), Water Code, and the
2929 district has completed all other procedures necessary for a
3030 limited-purpose annexation by that municipality, an emergency
3131 services district shall disannex the territory of the district to
3232 be served by the municipality under the agreement in accordance
3333 with Subsection (c).
3434 (c) The territory remains part of the emergency services
3535 district until the secretary of the emergency services district
3636 board receives from the district notice that the requirements of
3737 Subsection (b) have been met. On receipt of the notice, the board
3838 shall immediately change its records to show that the district
3939 territory has been disannexed from the emergency services district
4040 and shall cease to provide further services to the residents of that
4141 territory.
4242 (d) Sections 775.022(b), (c), (d), (e), and (f), Health and
4343 Safety Code, apply to a disannexation under this section, as if the
4444 disannexation occurred under the provisions of Section 775.022(a),
4545 Health and Safety Code.
4646 SECTION 2. (a) The legal notice of the intention to
4747 introduce this Act, setting forth the general substance of this
4848 Act, has been published as provided by law, and the notice and a
4949 copy of this Act have been furnished to all persons, agencies,
5050 officials, or entities to which they are required to be furnished
5151 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5252 Government Code.
5353 (b) The governor, one of the required recipients, has
5454 submitted the notice and Act to the Texas Commission on
5555 Environmental Quality.
5656 (c) The Texas Commission on Environmental Quality has filed
5757 its recommendations relating to this Act with the governor, the
5858 lieutenant governor, and the speaker of the house of
5959 representatives within the required time.
6060 (d) All requirements of the constitution and laws of this
6161 state and the rules and procedures of the legislature with respect
6262 to the notice, introduction, and passage of this Act are fulfilled
6363 and accomplished.
6464 SECTION 3. This Act takes effect September 1, 2013.
