99 AN ACT
1010 relating to use of the money from the Texas Enterprise Fund and the
1111 Texas emerging technology fund to benefit certain historically
1212 underutilized businesses.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 481.078, Government Code, is amended by
1515 adding Subsections (n) and (o) to read as follows:
1616 (n) To encourage the development and location of
1717 historically underutilized businesses in this state, the governor
1818 shall consider making grants from the fund:
1919 (1) to recipients that are historically underutilized
2020 businesses in this state that commit to using the grants to create
2121 additional jobs; or
2222 (2) to recipients that are historically underutilized
2323 businesses from outside the state that commit to relocate to this
2424 state.
2525 (o) For purposes of this section:
2626 (1) "Historically underutilized business" means:
2727 (A) a corporation formed for the purpose of
2828 making a profit in which 51 percent or more of all classes of the
2929 shares of stock or other equitable securities are owned by one or
3030 more economically disadvantaged persons who have a proportionate
3131 interest and actively participate in the corporation's control,
3232 operation, and management;
3333 (B) a sole proprietorship created for the purpose
3434 of making a profit that is completely owned, operated, and
3535 controlled by an economically disadvantaged person;
3636 (C) a partnership formed for the purpose of
3737 making a profit in which 51 percent or more of the assets and
3838 interest in the partnership are owned by one or more economically
3939 disadvantaged persons who have a proportionate interest and
4040 actively participate in the partnership's control, operation, and
4141 management; or
4242 (D) a joint venture in which each entity in the
4343 venture is a historically underutilized business, as determined
4444 under another paragraph of this subdivision.
4545 (2) "Economically disadvantaged person" has the
4646 meaning assigned by Section 2161.001.
4747 SECTION 2. Subsection (a), Section 481.079, Government
4848 Code, is amended to read as follows:
4949 (a) Before the beginning of each regular session of the
5050 legislature, the governor shall submit to the lieutenant governor,
5151 the speaker of the house of representatives, and each other member
5252 of the legislature a report on grants made under Section 481.078
5353 that states:
5454 (1) the number of direct jobs each recipient committed
5555 to create in this state;
5656 (2) the number of direct jobs each recipient created
5757 in this state;
5858 (3) the median wage of the jobs each recipient created
5959 in this state;
6060 (4) the amount of capital investment each recipient
6161 committed to expend or allocate per project in this state;
6262 (5) the amount of capital investment each recipient
6363 expended or allocated per project in this state;
6464 (6) the total amount of grants made to each recipient;
6565 (7) the average amount of money granted in this state
6666 for each job created in this state by grant recipients;
6767 (8) the number of jobs created in this state by grant
6868 recipients in each sector of the North American Industry
6969 Classification System (NAICS); [and]
7070 (9) of the number of direct jobs each recipient
7171 created in this state, the number of positions created that provide
7272 health benefits for employees; and
7373 (10) the total number of grant recipients that are
7474 historically underutilized businesses and the total amount of
7575 grants made to those recipients.
7676 SECTION 3. Section 490.101, Government Code, is amended by
7777 adding Subsections (j) and (k) to read as follows:
7878 (j) To encourage the development and location of
7979 historically underutilized businesses in this state, the governor
8080 shall consider making awards from the fund:
8181 (1) to recipients that are historically underutilized
8282 businesses in this state that commit to using the awards to create
8383 additional jobs; or
8484 (2) to recipients that are historically underutilized
8585 businesses from outside the state that commit to relocate to this
8686 state.
8787 (k) For purposes of this section:
8888 (1) "Historically underutilized business" means:
8989 (A) a corporation formed for the purpose of
9090 making a profit in which 51 percent or more of all classes of the
9191 shares of stock or other equitable securities are owned by one or
9292 more economically disadvantaged persons who have a proportionate
9393 interest and actively participate in the corporation's control,
9494 operation, and management;
9595 (B) a sole proprietorship created for the purpose
9696 of making a profit that is completely owned, operated, and
9797 controlled by an economically disadvantaged person;
9898 (C) a partnership formed for the purpose of
9999 making a profit in which 51 percent or more of the assets and
100100 interest in the partnership are owned by one or more economically
101101 disadvantaged persons who have a proportionate interest and
102102 actively participate in the partnership's control, operation, and
103103 management; or
104104 (D) a joint venture in which each entity in the
105105 venture is a historically underutilized business, as determined
106106 under another paragraph of this subdivision.
107107 (2) "Economically disadvantaged person" has the
108108 meaning assigned by Section 2161.001.
109109 SECTION 4. Subsection (b), Section 490.005, Government
110110 Code, is amended to read as follows:
111111 (b) The annual report must also contain:
112112 (1) the total number of jobs actually created by each
113113 project receiving funding under this chapter;
114114 (2) an analysis of the number of jobs actually created
115115 by each project receiving funding under this chapter; [and]
116116 (3) a brief description regarding:
117117 (A) the methodology used to determine the
118118 information provided under Subdivisions (1) and (2), which may be
119119 developed in consultation with the comptroller's office;
120120 (B) the intended outcomes of projects funded
121121 under Subchapter D during each preceding state fiscal year; and
122122 (C) the actual outcomes of all projects funded
123123 under Subchapter D during each preceding state fiscal year,
124124 including any financial impact on the state resulting from a
125125 liquidity event involving a company whose project was funded under
126126 that subchapter; and
127127 (4) the total number of recipients of awards from the
128128 fund that are historically underutilized businesses and the total
129129 amount of awards made to those recipients.
130130 SECTION 5. This Act takes effect immediately if it receives
131131 a vote of two-thirds of all the members elected to each house, as
132132 provided by Section 39, Article III, Texas Constitution. If this
133133 Act does not receive the vote necessary for immediate effect, this
134134 Act takes effect September 1, 2013.
