77 relating to the admission of undergraduate students to public
88 institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsections (a-3) and (k), Section 51.803,
1111 Education Code, are amended to read as follows:
1212 (a-3) Notwithstanding Subsection (a-1), The University of
1313 Texas at Austin may not offer admission under that subsection for an
1414 academic year after the 2017-2018 [2015-2016] academic year.
1515 (k) A general academic teaching institution may not offer
1616 admission under Subsection (a-1) for an academic year if, on the
1717 date of the institution's general deadline for applications for
1818 admission of first-time undergraduate students for that academic
1919 year:
2020 (1) federal law as then interpreted by applicable
2121 federal judicial decisions does not prohibit [a final court order
2222 applicable to the institution prohibits] the institution from
2323 considering an applicant's race or ethnicity as a factor in the
2424 institution's decisions relating to first-time undergraduate
2525 admissions; and [or]
2626 (2) the institution's governing board by rule, policy,
2727 or other manner has provided that an applicant's race or ethnicity
2828 may not be considered as a factor in the institution's decisions
2929 relating to first-time undergraduate admissions for that[, except
3030 that this subdivision does not apply to an institution that did not
3131 consider, on or before June 1, 2009, an applicant's race or
3232 ethnicity as a factor in its admissions of first-time resident
3333 undergraduate students for the 2009-2010] academic year.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2013.
