8 | 8 | | dropout and completion rates, of public schools designated as |
---|
9 | 9 | | dropout recovery schools. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter C, Chapter 39, Education Code, is |
---|
12 | 12 | | amended by adding Section 39.0545 to read as follows: |
---|
13 | 13 | | Sec. 39.0545. EVALUATING DROPOUT RECOVERY SCHOOLS. |
---|
14 | 14 | | (a) For purposes of evaluating performance under Section |
---|
15 | 15 | | 39.053(c), the commissioner shall designate as a dropout recovery |
---|
16 | 16 | | school a school district or an open-enrollment charter school or a |
---|
17 | 17 | | campus of a district or of an open-enrollment charter school: |
---|
18 | 18 | | (1) that serves students in grades 9 through 12 and has |
---|
19 | 19 | | an enrollment of which at least 50 percent of the students are 17 |
---|
20 | 20 | | years of age or older as of September 1 of the school year as |
---|
21 | 21 | | reported for the fall semester Public Education Information |
---|
22 | 22 | | Management System (PEIMS) submission; and |
---|
23 | 23 | | (2) that meets the eligibility requirements for and is |
---|
24 | 24 | | registered under alternative education accountability procedures |
---|
25 | 25 | | adopted by the commissioner. |
---|
26 | 26 | | (b) Notwithstanding Section 39.053(c)(2), the commissioner |
---|
27 | 27 | | shall use the alternative completion rate under this subsection to |
---|
28 | 28 | | determine the student achievement indicator under Section |
---|
29 | 29 | | 39.053(c)(2) for a dropout recovery school. The alternative |
---|
30 | 30 | | completion rate shall be the ratio of the total number of students |
---|
31 | 31 | | who graduate, continue attending school into the next academic |
---|
32 | 32 | | year, or receive a high school equivalency certificate to the total |
---|
33 | 33 | | number of students in the longitudinal cohort of students. |
---|
34 | 34 | | (c) Notwithstanding Section 39.053(c)(2), in determining |
---|
35 | 35 | | the performance rating under Section 39.054 of a dropout recovery |
---|
36 | 36 | | school, the commissioner shall include any student described by |
---|
37 | 37 | | Section 39.053(g-1) who graduates or receives a high school |
---|
38 | 38 | | equivalency certificate. |
---|
39 | 39 | | (d) For a dropout recovery school, only the best result from |
---|
40 | 40 | | the primary administration and any retake of an assessment |
---|
41 | 41 | | instrument administered to a student in the school year evaluated |
---|
42 | 42 | | under the accountability procedures adopted by the commissioner may |
---|
43 | 43 | | be considered in determining the performance rating of the school |
---|
44 | 44 | | under Section 39.054. |
---|
45 | 45 | | SECTION 2. This Act applies beginning with the 2013-2014 |
---|
46 | 46 | | school year. |
---|
47 | 47 | | SECTION 3. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2013. |
