99 relating to discipline of public school students by school bus
1010 drivers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.001(a), Education Code, is amended to
1313 read as follows:
1414 (a) The board of trustees of an independent school district
1515 shall, with the advice of its district-level committee established
1616 under Subchapter F, Chapter 11, adopt a student code of conduct for
1717 the district. The student code of conduct must be posted and
1818 prominently displayed at each school campus or made available for
1919 review at the office of the campus principal. In addition to
2020 establishing standards for student conduct, the student code of
2121 conduct must:
2222 (1) specify the circumstances, in accordance with this
2323 subchapter, under which a student may be removed from a classroom,
2424 campus, [or] disciplinary alternative education program, or school
2525 bus;
2626 (2) specify conditions that authorize or require a
2727 principal or other appropriate administrator to transfer a student
2828 to a disciplinary alternative education program;
2929 (3) outline conditions under which a student may be
3030 suspended as provided by Section 37.005 or expelled as provided by
3131 Section 37.007;
3232 (4) specify that consideration will be given, as a
3333 factor in each decision concerning suspension, removal to a
3434 disciplinary alternative education program, expulsion, or
3535 placement in a juvenile justice alternative education program,
3636 regardless of whether the decision concerns a mandatory or
3737 discretionary action, to:
3838 (A) self-defense;
3939 (B) intent or lack of intent at the time the
4040 student engaged in the conduct;
4141 (C) a student's disciplinary history; or
4242 (D) a disability that substantially impairs the
4343 student's capacity to appreciate the wrongfulness of the student's
4444 conduct;
4545 (5) provide guidelines for setting the length of a
4646 term of:
4747 (A) a removal under Section 37.006; and
4848 (B) an expulsion under Section 37.007;
4949 (6) address the notification of a student's parent or
5050 guardian of a violation of the student code of conduct committed by
5151 the student that results in suspension, removal to a disciplinary
5252 alternative education program, or expulsion;
5353 (7) prohibit bullying, harassment, and making hit
5454 lists and ensure that district employees enforce those
5555 prohibitions; and
5656 (8) provide, as appropriate for students at each grade
5757 level, methods, including options, for:
5858 (A) managing students in the classroom and on
5959 school grounds;
6060 (B) disciplining students; and
6161 (C) preventing and intervening in student
6262 discipline problems, including bullying, harassment, and making
6363 hit lists.
6464 SECTION 2. Subchapter A, Chapter 37, Education Code, is
6565 amended by adding Section 37.0022 to read as follows:
6666 Sec. 37.0022. REMOVAL BY SCHOOL BUS DRIVER. (a) The driver
6767 of a school bus transporting students to or from school or a
6868 school-sponsored or school-related activity may send a student to
6969 the principal's office to maintain effective discipline on the
7070 school bus. The principal shall respond by employing appropriate
7171 discipline management techniques consistent with the student code
7272 of conduct adopted under Section 37.001.
7373 (b) Section 37.004 applies to any placement under
7474 Subsection (a) of a student with a disability who receives special
7575 education services.
7676 SECTION 3. This Act applies beginning with the 2013-2014
7777 school year.
7878 SECTION 4. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2013.
