| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter B, Chapter 161, Utilities Code, is |
|---|
| 14 | 14 | | amended by adding Section 161.0721 to read as follows: |

| 15 | 15 | | Sec. 161.0721. ELECTION OF DIRECTORS IN CERTAIN LARGE |
|---|
| 16 | 16 | | COOPERATIVES. (a) This section applies only to an electric |
|---|
| 17 | 17 | | cooperative with more than 180,000 members that is partially |
|---|
| 18 | 18 | | located in a county with a population of more than one million and |
|---|
| 19 | 19 | | less than 1.5 million. |
|---|
| 20 | 20 | | (b) Directors may be elected only by district. The board |
|---|
| 21 | 21 | | shall establish single-member districts from which the directors |
|---|
| 22 | 22 | | are to be elected. In establishing districts, the board shall |
|---|
| 23 | 23 | | attempt to have directors represent geographic areas with equal |
|---|
| 24 | 24 | | numbers of people. |
|---|
| 25 | 25 | | (c) A member may vote for a director to represent a district |
|---|
| 26 | 26 | | only if the member resides in that district. |
|---|
| 27 | 27 | | SECTION 2. The changes in law made by Section 161.0721, |
|---|
| 28 | 28 | | Utilities Code, as added by this Act, apply only to a director |
|---|
| 29 | 29 | | election held on or after the effective date of this Act. A |
|---|
| 30 | 30 | | director election held before the effective date of this Act is |
|---|
| 31 | 31 | | subject to the law in effect on the date the election is held, and |
|---|
| 32 | 32 | | that law is continued in effect for that purpose. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2013. |
