99 AN ACT
1010 relating to water management planning by the Lower Colorado River
1111 Authority.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 8503, Special District Local Laws Code,
1414 is amended by adding Sections 8503.032 and 8503.033 to read as
1515 follows:
1616 Sec. 8503.032. WATER MANAGEMENT PLAN. (a) In this section
1717 and Section 8503.033:
1818 (1) "Firm water" means a supply of water for customers
1919 of the authority that must be supplied 100 percent of the time
2020 without shortage through a repeat of the drought of record.
2121 (2) "Interruptible water" means a supply of water for
2222 customers of the authority that does not have to be met 100 percent
2323 of the time and must be interrupted or curtailed as provided by
2424 Subsections (b) and (c).
2525 (b) The authority shall interrupt or curtail the supply of
2626 water under the authority's certificates of adjudication 14-5478
2727 and 14-5482, as amended, pursuant to commitments that are
2828 specifically subject to interruption or curtailment, to the extent
2929 necessary to allow the authority to satisfy all demands for water
3030 under such permits pursuant to all firm, uninterruptible
3131 commitments.
3232 (c) Supply of interruptible water must be cut off entirely
3333 before the authority curtails supplies of firm water or requests
3434 that firm water customers institute voluntary drought contingency
3535 measures.
3636 (d) The authority's water management plan must:
3737 (1) ensure that firm water supplies are available to
3838 meet all existing and projected demands of firm water customers to
3939 the extent provided by:
4040 (A) the April 20, 1988, Final Judgment and Decree
4141 adjudicating water rights in the Lower Colorado River Basin ("1988
4242 Final Judgment and Decree");
4343 (B) any orders issued by the commission or
4444 predecessor agencies subsequent to the 1988 Final Judgment and
4545 Decree approving the authority's water management plan for the
4646 operation of Lakes Travis and Buchanan;
4747 (C) water rights adjudicated by the 1988 Final
4848 Judgment and Decree, and issued by the commission, as amended; and
4949 (D) the provisions of the Water Code, rules of
5050 the commission, or other law; and
5151 (2) cease all water releases of interruptible water
5252 when the combined storage of Lakes Travis and Buchanan is at or
5353 below 850,000 acre-feet.
5454 Sec. 8503.033. FIRM WATER PROTECTION. Section 8503.032
5555 does not, and the legislature does not intend to, diminish,
5656 decrease, limit, impair, or modify, in any manner that is
5757 detrimental to firm water customers, the authority's commitments or
5858 contractual obligations to firm water customers or firm water
5959 customers' rights, entitlements, protections, prioritization, or
6060 status as either are set forth in:
6161 (1) the April 20, 1988, Final Judgment and Decree
6262 adjudicating water rights in the Lower Colorado River Basin ("1988
6363 Final Judgment and Decree");
6464 (2) any orders issued by the commission or predecessor
6565 agencies subsequent to the 1988 Final Judgment and Decree approving
6666 the authority's water management plan for operation of Lakes Travis
6767 and Buchanan;
6868 (3) any water management plan of the authority
6969 approved by the commission;
7070 (4) any permits or certificates of adjudication or
7171 amendments of these issued by the commission subsequent to the 1988
7272 Final Judgment and Decree;
7373 (5) any existing water supply agreements or other
7474 agreements between the authority and firm water customers;
7575 (6) any rules, policies, or similar guidance documents
7676 of the authority;
7777 (7) any rules, policies, or similar guidance documents
7878 of the commission;
7979 (8) the Water Code, this code, or any other law; or
8080 (9) any other document.
8181 SECTION 2. The Lower Colorado River Authority shall adopt
8282 or amend its rules and its water management plan as required to
8383 implement Sections 8503.032 and 8503.033, Special District Local
8484 Laws Code, as added by this Act.
8585 SECTION 3. This Act takes effect September 1, 2013.
