77 relating to the creation of an advisory committee to examine the
88 fingerprinting practices of juvenile probation departments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. FINGERPRINTING ADVISORY COMMITTEE. Not later
1111 than December 1, 2013, the Texas Juvenile Justice Board shall
1212 appoint an advisory committee to develop a plan to end the practice
1313 of fingerprinting children referred to a juvenile probation
1414 department for delinquent conduct, other than felony conduct. The
1515 plan must ensure that public safety and due process rights are
1616 protected.
1717 SECTION 2. APPOINTMENTS; PRESIDING OFFICER. (a) In making
1818 appointments to the advisory committee, the board shall include
1919 members who are interested parties, including:
2020 (1) chief juvenile probation officers;
2121 (2) juvenile prosecutors;
2222 (3) juvenile defense attorneys;
2323 (4) peace officers;
2424 (5) representatives of the Department of Family and
2525 Protective Services;
2626 (6) juvenile justice advocates; and
2727 (7) members of the public.
2828 (b) The board shall designate one of the members as
2929 presiding officer of the advisory committee.
3030 SECTION 3. REPORT. Not later than December 1, 2014, the
3131 advisory committee shall submit to the board the plan developed
3232 under Section 1.
3333 SECTION 4. COMPENSATION. Members of the advisory committee
3434 serve without compensation and are not entitled to reimbursement
3535 for expenses.
3636 SECTION 5. APPLICATION OF LAWS GOVERNING ADVISORY
3737 COMMITTEES. The advisory committee is not subject to Chapter 2110,
3838 Government Code.
3939 SECTION 6. EXPIRATION DATE. The advisory committee is
4040 abolished and this Act expires January 1, 2015.
4141 SECTION 7. EFFECTIVE DATE. This Act takes effect
4242 immediately if it receives a vote of two-thirds of all the members
4343 elected to each house, as provided by Section 39, Article III, Texas
4444 Constitution. If this Act does not receive the vote necessary for
4545 immediate effect, this Act takes effect September 1, 2013.
