99 AN ACT
1010 relating to the dissolution of the Harris County Municipal Utility
1111 District No. 213; the creation of the Harris County Municipal
1212 Utility District No. 213-A; the creation of the Harris County
1313 Municipal Utility District No. 213-B; granting a limited power of
1414 eminent domain; providing authority to issue bonds; providing
1515 authority to impose assessments, fees, or taxes.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. On the effective date of this Act:
1818 (1) the Harris County Municipal Utility District No.
1919 213 is dissolved;
2020 (2) the terms of the directors of the district expire;
2121 and
2222 (3) any assets of the district, including any tax or
2323 assessment revenue, that remain after payment of the district's
2424 liabilities are transferred to the Harris County Municipal Utility
2525 District No. 213-A.
2626 SECTION 2. Subtitle F, Title 6, Special District Local Laws
2727 Code, is amended by adding Chapter 8478 to read as follows:
2828 CHAPTER 8478. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 213-A
2929 SUBCHAPTER A. GENERAL PROVISIONS
3030 Sec. 8478.001. DEFINITIONS. In this chapter:
3131 (1) "Board" means the district's board of directors.
3232 (2) "Commission" means the Texas Commission on
3333 Environmental Quality.
3434 (3) "Director" means a board member.
3535 (4) "District" means the Harris County Municipal
3636 Utility District No. 213-A.
3737 Sec. 8478.002. NATURE OF DISTRICT. The district is a
3838 municipal utility district created under Section 59, Article XVI,
3939 Texas Constitution.
4040 Sec. 8478.003. CONFIRMATION AND DIRECTORS' ELECTION
4141 REQUIRED. The temporary directors shall hold an election to
4242 confirm the creation of the district and to elect five permanent
4343 directors as provided by Section 49.102, Water Code.
4444 Sec. 8478.004. CONSENT OF MUNICIPALITY REQUIRED. The
4545 temporary directors may not hold an election under Section 8478.003
4646 until each municipality in whose corporate limits or
4747 extraterritorial jurisdiction the district is located has
4848 consented by ordinance or resolution to the creation of the
4949 district and to the inclusion of land in the district.
5050 Sec. 8478.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
5151 (a) The district is created to serve a public purpose and benefit.
5252 (b) The district is created to accomplish the purposes of:
5353 (1) a municipal utility district as provided by
5454 general law and Section 59, Article XVI, Texas Constitution; and
5555 (2) Section 52, Article III, Texas Constitution, that
5656 relate to the construction, acquisition, improvement, operation,
5757 or maintenance of macadamized, graveled, or paved roads, or
5858 improvements, including storm drainage, in aid of those roads.
5959 Sec. 8478.006. INITIAL DISTRICT TERRITORY. (a) The
6060 district is initially composed of the territory described by
6161 Section 3 of the Act enacting this chapter.
6262 (b) The boundaries and field notes contained in Section 3 of
6363 the Act enacting this chapter form a closure. A mistake made in the
6464 field notes or in copying the field notes in the legislative process
6565 does not affect the district's:
6666 (1) organization, existence, or validity;
6767 (2) right to issue any type of bond for the purposes
6868 for which the district is created or to pay the principal of and
6969 interest on a bond;
7070 (3) right to impose a tax; or
7171 (4) legality or operation.
7272 Sec. 8478.007. ANNEXATION BY MUNICIPALITY.
7373 Notwithstanding any other law, if all of the territory of the
7474 district is annexed by a municipality into the corporate limits of
7575 that municipality before the date of the election under Section
7676 8478.003, the district may not be dissolved and shall continue
7777 until the district is dissolved under Section 43.074, Local
7878 Government Code.
7979 SUBCHAPTER B. BOARD OF DIRECTORS
8080 Sec. 8478.051. GOVERNING BODY; TERMS. (a) The district is
8181 governed by a board of five elected directors.
8282 (b) Except as provided by Section 8478.052, directors serve
8383 staggered four-year terms.
8484 Sec. 8478.052. TEMPORARY DIRECTORS. (a) The temporary
8585 board consists of:
8686 (1) William K. Taylor;
8787 (2) James Coursey; and
8888 (3) Jacob Saour.
8989 (b) Temporary directors serve until the earlier of:
9090 (1) the date permanent directors are elected under
9191 Section 8478.003; or
9292 (2) September 1, 2017.
9393 (c) If permanent directors have not been elected under
9494 Section 8478.003 and the terms of the temporary directors have
9595 expired, successor temporary directors shall be appointed or
9696 reappointed as provided by Subsection (d) to serve terms that
9797 expire on the earlier of:
9898 (1) the date permanent directors are elected under
9999 Section 8478.003; or
100100 (2) the fourth anniversary of the date of the
101101 appointment or reappointment.
102102 (d) If Subsection (c) applies, the owner or owners of a
103103 majority of the assessed value of the real property in the district
104104 may submit a petition to the commission requesting that the
105105 commission appoint as successor temporary directors the five
106106 persons named in the petition. The commission shall appoint as
107107 successor temporary directors the five persons named in the
108108 petition.
109109 SUBCHAPTER C. POWERS AND DUTIES
110110 Sec. 8478.101. GENERAL POWERS AND DUTIES. The district has
111111 the powers and duties necessary to accomplish the purposes for
112112 which the district is created.
113113 Sec. 8478.102. MUNICIPAL UTILITY DISTRICT POWERS AND
114114 DUTIES. The district has the powers and duties provided by the
115115 general law of this state, including Chapters 49 and 54, Water Code,
116116 applicable to municipal utility districts created under Section 59,
117117 Article XVI, Texas Constitution.
118118 Sec. 8478.103. AUTHORITY FOR ROAD PROJECTS. Under Section
119119 52, Article III, Texas Constitution, the district may design,
120120 acquire, construct, finance, issue bonds for, improve, operate,
121121 maintain, and convey to this state, a county, or a municipality for
122122 operation and maintenance macadamized, graveled, or paved roads, or
123123 improvements, including storm drainage, in aid of those roads.
124124 Sec. 8478.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
125125 road project must meet all applicable construction standards,
126126 zoning and subdivision requirements, and regulations of each
127127 municipality in whose corporate limits or extraterritorial
128128 jurisdiction the road project is located.
129129 (b) If a road project is not located in the corporate limits
130130 or extraterritorial jurisdiction of a municipality, the road
131131 project must meet all applicable construction standards,
132132 subdivision requirements, and regulations of each county in which
133133 the road project is located.
134134 (c) If the state will maintain and operate the road, the
135135 Texas Transportation Commission must approve the plans and
136136 specifications of the road project.
137137 Sec. 8478.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
138138 OR RESOLUTION. The district shall comply with all applicable
139139 requirements of any ordinance or resolution that is adopted under
140140 Section 54.016 or 54.0165, Water Code, and that consents to the
141141 creation of the district or to the inclusion of land in the
142142 district.
143143 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
144144 Sec. 8478.151. DIVISION OF DISTRICT; PREREQUISITES. The
145145 district may be divided into two or more new districts only if the
146146 district:
147147 (1) has no outstanding bonded debt; and
148148 (2) is not imposing ad valorem taxes.
149149 Sec. 8478.152. LAW APPLICABLE TO NEW DISTRICT. This
150150 chapter applies to any new district created by division of the
151151 district, and a new district has all the powers and duties of the
152152 district.
153153 Sec. 8478.153. LIMITATION ON AREA OF NEW DISTRICT. A new
154154 district created by the division of the district may not, at the
155155 time the new district is created, contain any land outside the area
156156 described by Section 3 of the Act enacting this chapter.
157157 Sec. 8478.154. DIVISION PROCEDURES. (a) The board, on its
158158 own motion or on receipt of a petition signed by the owner or owners
159159 of a majority of the assessed value of the real property in the
160160 district, may adopt an order dividing the district.
161161 (b) The board may adopt an order dividing the district
162162 before or after the date the board holds an election under Section
163163 8478.003 to confirm the district's creation.
164164 (c) An order dividing the district must:
165165 (1) name each new district;
166166 (2) include the metes and bounds description of the
167167 territory of each new district;
168168 (3) appoint temporary directors for each new district;
169169 and
170170 (4) provide for the division of assets and liabilities
171171 between the new districts.
172172 (d) On or before the 30th day after the date of adoption of
173173 an order dividing the district, the district shall file the order
174174 with the commission and record the order in the real property
175175 records of each county in which the district is located.
176176 Sec. 8478.155. CONFIRMATION ELECTION FOR NEW DISTRICT.
177177 (a) A new district created by the division of the district shall
178178 hold a confirmation and directors' election as required by Section
179179 8478.003.
180180 (b) If the creation of the new district is confirmed, the
181181 new district shall provide the election date and results to the
182182 commission.
183183 Sec. 8478.156. TAX OR BOND ELECTION. Before a new district
184184 created by the division of the district may impose a maintenance tax
185185 or issue bonds payable wholly or partly from ad valorem taxes, the
186186 new district must hold an election as required by this chapter to
187187 obtain voter approval.
188188 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
189189 Sec. 8478.201. ELECTIONS REGARDING TAXES OR BONDS.
190190 (a) The district may issue, without an election, bonds and other
191191 obligations secured by:
192192 (1) revenue other than ad valorem taxes; or
193193 (2) contract payments described by Section 8478.203.
194194 (b) The district must hold an election in the manner
195195 provided by Chapters 49 and 54, Water Code, to obtain voter approval
196196 before the district may impose an ad valorem tax or issue bonds
197197 payable from ad valorem taxes.
198198 (c) The district may not issue bonds payable from ad valorem
199199 taxes to finance a road project unless the issuance is approved by a
200200 vote of a two-thirds majority of the district voters voting at an
201201 election held for that purpose.
202202 Sec. 8478.202. OPERATION AND MAINTENANCE TAX. (a) If
203203 authorized at an election held under Section 8478.201, the district
204204 may impose an operation and maintenance tax on taxable property in
205205 the district in accordance with Section 49.107, Water Code.
206206 (b) The board shall determine the tax rate. The rate may not
207207 exceed the rate approved at the election.
208208 Sec. 8478.203. CONTRACT TAXES. (a) In accordance with
209209 Section 49.108, Water Code, the district may impose a tax other than
210210 an operation and maintenance tax and use the revenue derived from
211211 the tax to make payments under a contract after the provisions of
212212 the contract have been approved by a majority of the district voters
213213 voting at an election held for that purpose.
214214 (b) A contract approved by the district voters may contain a
215215 provision stating that the contract may be modified or amended by
216216 the board without further voter approval.
217217 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
218218 Sec. 8478.251. AUTHORITY TO ISSUE BONDS AND OTHER
219219 OBLIGATIONS. The district may issue bonds or other obligations
220220 payable wholly or partly from ad valorem taxes, impact fees,
221221 revenue, contract payments, grants, or other district money, or any
222222 combination of those sources, to pay for any authorized district
223223 purpose.
224224 Sec. 8478.252. TAXES FOR BONDS. At the time the district
225225 issues bonds payable wholly or partly from ad valorem taxes, the
226226 board shall provide for the annual imposition of a continuing
227227 direct ad valorem tax, without limit as to rate or amount, while all
228228 or part of the bonds are outstanding.
229229 Sec. 8478.253. BONDS FOR ROAD PROJECTS. At the time of
230230 issuance, the total principal amount of bonds or other obligations
231231 issued or incurred to finance road projects and payable from ad
232232 valorem taxes may not exceed one-fourth of the assessed value of the
233233 real property in the district.
234234 SECTION 3. The Harris County Municipal Utility District No.
235235 213-A initially includes all the territory contained in the
236236 following area:
237237 BEING A TRACT OF LAND CONTAINING 571.898 ACRES, MORE OR LESS,
238238 SITUATED IN THE TALCOT PATCHING SURVEY, ABSTRACT NO. 620, HARRIS
239239 COUNTY, TEXAS, CONSISTING OF THAT CERTAIN 697.0651-ACRE TRACT
240240 DESCRIBED BY METES AND BOUNDS BELOW, SAVE AND EXCEPT THAT CERTAIN
241241 111.307-ACRE TRACT ("SAVE AND EXCEPT TRACT 1") DESCRIBED BY METES
242242 AND BOUNDS BELOW, AND SAVE AND EXCEPT THAT CERTAIN 13.860-ACRE

460460 Code, is amended by adding Chapter 8479 to read as follows:
461461 CHAPTER 8479. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 213-B
462462 SUBCHAPTER A. GENERAL PROVISIONS
463463 Sec. 8479.001. DEFINITIONS. In this chapter:
464464 (1) "Board" means the district's board of directors.
465465 (2) "Commission" means the Texas Commission on
466466 Environmental Quality.
467467 (3) "Director" means a board member.
468468 (4) "District" means the Harris County Municipal
469469 Utility District No. 213-B.
470470 Sec. 8479.002. NATURE OF DISTRICT. The district is a
471471 municipal utility district created under Section 59, Article XVI,
472472 Texas Constitution.
473473 Sec. 8479.003. CONFIRMATION AND DIRECTORS' ELECTION
474474 REQUIRED. The temporary directors shall hold an election to
475475 confirm the creation of the district and to elect five permanent
476476 directors as provided by Section 49.102, Water Code.
477477 Sec. 8479.004. CONSENT OF MUNICIPALITY REQUIRED. The
478478 temporary directors may not hold an election under Section 8479.003
479479 until each municipality in whose corporate limits or
480480 extraterritorial jurisdiction the district is located has
481481 consented by ordinance or resolution to the creation of the
482482 district and to the inclusion of land in the district.
483483 Sec. 8479.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
484484 (a) The district is created to serve a public purpose and benefit.
485485 (b) The district is created to accomplish the purposes of:
486486 (1) a municipal utility district as provided by
487487 general law and Section 59, Article XVI, Texas Constitution; and
488488 (2) Section 52, Article III, Texas Constitution, that
489489 relate to the construction, acquisition, improvement, operation,
490490 or maintenance of macadamized, graveled, or paved roads, or
491491 improvements, including storm drainage, in aid of those roads.
492492 Sec. 8479.006. INITIAL DISTRICT TERRITORY. (a) The
493493 district is initially composed of the territory described by
494494 Section 5 of the Act enacting this chapter.
495495 (b) The boundaries and field notes contained in Section 5 of
496496 the Act enacting this chapter form a closure. A mistake made in the
497497 field notes or in copying the field notes in the legislative process
498498 does not affect the district's:
499499 (1) organization, existence, or validity;
500500 (2) right to issue any type of bond for the purposes
501501 for which the district is created or to pay the principal of and
502502 interest on a bond;
503503 (3) right to impose a tax; or
504504 (4) legality or operation.
505505 Sec. 8479.007. ANNEXATION BY MUNICIPALITY.
506506 Notwithstanding any other law, if all of the territory of the
507507 district is annexed by a municipality into the corporate limits of
508508 that municipality before the date of the election under Section
509509 8479.003, the district may not be dissolved and shall continue
510510 until the district is dissolved under Section 43.074, Local
511511 Government Code.
512512 SUBCHAPTER B. BOARD OF DIRECTORS
513513 Sec. 8479.051. GOVERNING BODY; TERMS. (a) The district is
514514 governed by a board of five elected directors.
515515 (b) Except as provided by Section 8479.052, directors serve
516516 staggered four-year terms.
517517 Sec. 8479.052. TEMPORARY DIRECTORS. (a) On or after
518518 September 1, 2013, the owner or owners of a majority of the assessed
519519 value of the real property in the district may submit a petition to
520520 the commission requesting that the commission appoint as temporary
521521 directors the five persons named in the petition. The commission
522522 shall appoint as temporary directors the five persons named in the
523523 petition.
524524 (b) Temporary directors serve until the earlier of:
525525 (1) the date permanent directors are elected under
526526 Section 8479.003; or
527527 (2) September 1, 2017.
528528 (c) If permanent directors have not been elected under
529529 Section 8479.003 and the terms of the temporary directors have
530530 expired, successor temporary directors shall be appointed or
531531 reappointed as provided by Subsection (d) to serve terms that
532532 expire on the earlier of:
533533 (1) the date permanent directors are elected under
534534 Section 8479.003; or
535535 (2) the fourth anniversary of the date of the
536536 appointment or reappointment.
537537 (d) If Subsection (c) applies, the owner or owners of a
538538 majority of the assessed value of the real property in the district
539539 may submit a petition to the commission requesting that the
540540 commission appoint as successor temporary directors the five
541541 persons named in the petition. The commission shall appoint as
542542 successor temporary directors the five persons named in the
543543 petition.
544544 SUBCHAPTER C. POWERS AND DUTIES
545545 Sec. 8479.101. GENERAL POWERS AND DUTIES. The district has
546546 the powers and duties necessary to accomplish the purposes for
547547 which the district is created.
548548 Sec. 8479.102. MUNICIPAL UTILITY DISTRICT POWERS AND
549549 DUTIES. The district has the powers and duties provided by the
550550 general law of this state, including Chapters 49 and 54, Water Code,
551551 applicable to municipal utility districts created under Section 59,
552552 Article XVI, Texas Constitution.
553553 Sec. 8479.103. AUTHORITY FOR ROAD PROJECTS. Under Section
554554 52, Article III, Texas Constitution, the district may design,
555555 acquire, construct, finance, issue bonds for, improve, operate,
556556 maintain, and convey to this state, a county, or a municipality for
557557 operation and maintenance macadamized, graveled, or paved roads, or
558558 improvements, including storm drainage, in aid of those roads.
559559 Sec. 8479.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
560560 road project must meet all applicable construction standards,
561561 zoning and subdivision requirements, and regulations of each
562562 municipality in whose corporate limits or extraterritorial
563563 jurisdiction the road project is located.
564564 (b) If a road project is not located in the corporate limits
565565 or extraterritorial jurisdiction of a municipality, the road
566566 project must meet all applicable construction standards,
567567 subdivision requirements, and regulations of each county in which
568568 the road project is located.
569569 (c) If the state will maintain and operate the road, the
570570 Texas Transportation Commission must approve the plans and
571571 specifications of the road project.
572572 Sec. 8479.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
573573 OR RESOLUTION. The district shall comply with all applicable
574574 requirements of any ordinance or resolution that is adopted under
575575 Section 54.016 or 54.0165, Water Code, and that consents to the
576576 creation of the district or to the inclusion of land in the
577577 district.
578578 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
579579 Sec. 8479.151. DIVISION OF DISTRICT; PREREQUISITES. The
580580 district may be divided into two or more new districts only if the
581581 district:
582582 (1) has no outstanding bonded debt; and
583583 (2) is not imposing ad valorem taxes.
584584 Sec. 8479.152. LAW APPLICABLE TO NEW DISTRICT. This
585585 chapter applies to any new district created by division of the
586586 district, and a new district has all the powers and duties of the
587587 district.
588588 Sec. 8479.153. LIMITATION ON AREA OF NEW DISTRICT. A new
589589 district created by the division of the district may not, at the
590590 time the new district is created, contain any land outside the area
591591 described by Section 5 of the Act enacting this chapter.
592592 Sec. 8479.154. DIVISION PROCEDURES. (a) The board, on its
593593 own motion or on receipt of a petition signed by the owner or owners
594594 of a majority of the assessed value of the real property in the
595595 district, may adopt an order dividing the district.
596596 (b) The board may adopt an order dividing the district
597597 before or after the date the board holds an election under Section
598598 8479.003 to confirm the district's creation.
599599 (c) An order dividing the district must:
600600 (1) name each new district;
601601 (2) include the metes and bounds description of the
602602 territory of each new district;
603603 (3) appoint temporary directors for each new district;
604604 and
605605 (4) provide for the division of assets and liabilities
606606 between the new districts.
607607 (d) On or before the 30th day after the date of adoption of
608608 an order dividing the district, the district shall file the order
609609 with the commission and record the order in the real property
610610 records of each county in which the district is located.
611611 Sec. 8479.155. CONFIRMATION ELECTION FOR NEW DISTRICT.
612612 (a) A new district created by the division of the district shall
613613 hold a confirmation and directors' election as required by Section
614614 8479.003.
615615 (b) If the creation of the new district is confirmed, the
616616 new district shall provide the election date and results to the
617617 commission.
618618 Sec. 8479.156. TAX OR BOND ELECTION. Before a new district
619619 created by the division of the district may impose a maintenance tax
620620 or issue bonds payable wholly or partly from ad valorem taxes, the
621621 new district must hold an election as required by this chapter to
622622 obtain voter approval.
623623 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
624624 Sec. 8479.201. ELECTIONS REGARDING TAXES OR BONDS.
625625 (a) The district may issue, without an election, bonds and other
626626 obligations secured by:
627627 (1) revenue other than ad valorem taxes; or
628628 (2) contract payments described by Section 8479.203.
629629 (b) The district must hold an election in the manner
630630 provided by Chapters 49 and 54, Water Code, to obtain voter approval
631631 before the district may impose an ad valorem tax or issue bonds
632632 payable from ad valorem taxes.
633633 (c) The district may not issue bonds payable from ad valorem
634634 taxes to finance a road project unless the issuance is approved by a
635635 vote of a two-thirds majority of the district voters voting at an
636636 election held for that purpose.
637637 Sec. 8479.202. OPERATION AND MAINTENANCE TAX. (a) If
638638 authorized at an election held under Section 8479.201, the district
639639 may impose an operation and maintenance tax on taxable property in
640640 the district in accordance with Section 49.107, Water Code.
641641 (b) The board shall determine the tax rate. The rate may not
642642 exceed the rate approved at the election.
643643 Sec. 8479.203. CONTRACT TAXES. (a) In accordance with
644644 Section 49.108, Water Code, the district may impose a tax other than
645645 an operation and maintenance tax and use the revenue derived from
646646 the tax to make payments under a contract after the provisions of
647647 the contract have been approved by a majority of the district voters
648648 voting at an election held for that purpose.
649649 (b) A contract approved by the district voters may contain a
650650 provision stating that the contract may be modified or amended by
651651 the board without further voter approval.
652652 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
653653 Sec. 8479.251. AUTHORITY TO ISSUE BONDS AND OTHER
654654 OBLIGATIONS. The district may issue bonds or other obligations
655655 payable wholly or partly from ad valorem taxes, impact fees,
656656 revenue, contract payments, grants, or other district money, or any
657657 combination of those sources, to pay for any authorized district
658658 purpose.
659659 Sec. 8479.252. TAXES FOR BONDS. At the time the district
660660 issues bonds payable wholly or partly from ad valorem taxes, the
661661 board shall provide for the annual imposition of a continuing
662662 direct ad valorem tax, without limit as to rate or amount, while all
663663 or part of the bonds are outstanding.
664664 Sec. 8479.253. BONDS FOR ROAD PROJECTS. At the time of
665665 issuance, the total principal amount of bonds or other obligations
666666 issued or incurred to finance road projects and payable from ad
667667 valorem taxes may not exceed one-fourth of the assessed value of the
668668 real property in the district.
669669 SECTION 5. The Harris County Municipal Utility District
670670 No. 213-B initially includes all the territory contained in the
671671 following area:

854854 (b) The governor, one of the required recipients, has
855855 submitted the notice and Act to the Texas Commission on
856856 Environmental Quality.
857857 (c) The Texas Commission on Environmental Quality has filed
858858 its recommendations relating to this Act with the governor, the
859859 lieutenant governor, and the speaker of the house of
860860 representatives within the required time.
861861 (d) All requirements of the constitution and laws of this
862862 state and the rules and procedures of the legislature with respect
863863 to the notice, introduction, and passage of this Act are fulfilled
864864 and accomplished.
865865 SECTION 7. (a) If this Act does not receive a two-thirds
866866 vote of all the members elected to each house, Subchapter C, Chapter
867867 8478, Special District Local Laws Code, as added by Section 2 of
868868 this Act, is amended by adding Section 8478.106 to read as follows:
869869 Sec. 8478.106. NO EMINENT DOMAIN POWER. The district may
870870 not exercise the power of eminent domain.
871871 (b) This section is not intended to be an expression of a
872872 legislative interpretation of the requirements of Subsection (c),
873873 Section 17, Article I, Texas Constitution.
874874 SECTION 8. (a) If this Act does not receive a two-thirds

877877 this Act, is amended by adding Section 8479.106 to read as follows:
