77 relating to restrictive covenants regulating drought-resistant
88 landscaping or water-conserving natural turf.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 202.007, Property Code, is amended by
1111 amending Subsections (a) and (d) and adding Subsection (d-1) to
1212 read as follows:
1313 (a) A property owners' association may not include or
1414 enforce a provision in a dedicatory instrument that prohibits or
1515 restricts a property owner from:
1616 (1) implementing measures promoting solid-waste
1717 composting of vegetation, including grass clippings, leaves, or
1818 brush, or leaving grass clippings uncollected on grass;
1919 (2) installing rain barrels or a rainwater harvesting
2020 system; [or]
2121 (3) implementing efficient irrigation systems,
2222 including underground drip or other drip systems; or
2323 (4) using drought-resistant landscaping or
2424 water-conserving natural turf.
2525 (d) This section does not:
2626 (1) restrict a property owners' association from
2727 regulating the requirements, including size, type, shielding, and
2828 materials, for or the location of a composting device if the
2929 restriction does not prohibit the economic installation of the
3030 device on the property owner's property where there is reasonably
3131 sufficient area to install the device;
3232 (2) require a property owners' association to permit a
3333 device described by Subdivision (1) to be installed in or on
3434 property:
3535 (A) owned by the property owners' association;
3636 (B) owned in common by the members of the
3737 property owners' association; or
3838 (C) in an area other than the fenced yard or patio
3939 of a property owner;
4040 (3) prohibit a property owners' association from
4141 regulating the installation of efficient irrigation systems,
4242 including establishing visibility limitations for aesthetic
4343 purposes;
4444 (4) prohibit a property owners' association from
4545 regulating the installation or use of gravel, rocks, or cacti;
4646 (5) restrict a property owners' association from
4747 regulating yard and landscape maintenance if the restrictions or
4848 requirements do not restrict or prohibit turf or landscaping design
4949 that promotes water conservation;
5050 (6) require a property owners' association to permit a
5151 rain barrel or rainwater harvesting system to be installed in or on
5252 property if:
5353 (A) the property is:
5454 (i) owned by the property owners'
5555 association;
5656 (ii) owned in common by the members of the
5757 property owners' association; or
5858 (iii) located between the front of the
5959 property owner's home and an adjoining or adjacent street; or
6060 (B) the barrel or system:
6161 (i) is of a color other than a color
6262 consistent with the color scheme of the property owner's home; or
6363 (ii) displays any language or other content
6464 that is not typically displayed by such a barrel or system as it is
6565 manufactured; [or]
6666 (7) restrict a property owners' association from
6767 regulating the size, type, and shielding of, and the materials used
6868 in the construction of, a rain barrel, rainwater harvesting device,
6969 or other appurtenance that is located on the side of a house or at
7070 any other location that is visible from a street, another lot, or a
7171 common area if:
7272 (A) the restriction does not prohibit the
7373 economic installation of the device or appurtenance on the property
7474 owner's property; and
7575 (B) there is a reasonably sufficient area on the
7676 property owner's property in which to install the device or
7777 appurtenance; or
7878 (8) prohibit a property owners' association from
7979 requiring an owner to submit a detailed description or a plan for
8080 the installation of drought-resistant landscaping or
8181 water-conserving natural turf for review and approval by the
8282 property owners' association to ensure, to the extent practicable,
8383 maximum aesthetic compatibility with other landscaping in the
8484 subdivision.
8585 (d-1) A property owners' association may not unreasonably
8686 deny or withhold approval of a proposed installation of
8787 drought-resistant landscaping or water-conserving natural turf
8888 under Subsection (d)(8) or unreasonably determine that the proposed
8989 installation is aesthetically incompatible with other landscaping
9090 in the subdivision.
9191 SECTION 2. This Act takes effect September 1, 2013.
