77 relating to the designation for criminal prosecution and other
88 purposes of certain chemicals commonly referred to as synthetic
99 cannabinoids as controlled substances and controlled substance
1010 analogues under the Texas Controlled Substances Act.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subdivisions (5) and (6), Section 481.002,
1313 Health and Safety Code, are amended to read as follows:
1414 (5) "Controlled substance" means a substance,
1515 including a drug, an adulterant, and a dilutant, listed in
1616 Schedules I through V or Penalty Group [Groups] 1, 1-A, [or] 2, 2-A,
1717 3, or [through] 4. The term includes the aggregate weight of any
1818 mixture, solution, or other substance containing a controlled
1919 substance.
2020 (6) "Controlled substance analogue" means:
2121 (A) a substance with a chemical structure
2222 substantially similar to the chemical structure of a controlled
2323 substance in Schedule I or II or Penalty Group 1, 1-A, [or] 2, or
2424 2-A; or
2525 (B) a substance specifically designed to produce
2626 an effect substantially similar to, or greater than, the effect of a
2727 controlled substance in Schedule I or II or Penalty Group 1, 1-A,
2828 [or] 2, or 2-A.
2929 SECTION 2. Section 481.1031, Health and Safety Code, is
3030 amended to read as follows:
3131 Sec. 481.1031. PENALTY GROUP 2-A. Penalty Group 2-A
3232 consists of any material, compound, mixture, or preparation that
3333 contains any quantity of a synthetic chemical substance, including
3434 its salts, isomers, and salts of isomers, listed by name in this
3535 section or contained within the following structural classes
3636 defined in this section [compound that is a cannabinoid receptor
3737 agonist and mimics the pharmacological effect of naturally
3838 occurring cannabinoids, including]:
3939 WIN-55,212-2;
4040 Naphthoylindole: any compound [naphthoylindoles]
4141 structurally derived from 3-(1-naphthoyl)indole or
4242 3-(2-naphthoyl)indole by substitution at the nitrogen atom of the
4343 indole ring by alkyl, haloalkyl, benzyl, halobenzyl, alkenyl,
4444 haloalkenyl, alkoxy, cyanoalkyl, hydroxyalkyl, cycloalkylmethyl,

366366 SECTION 3. Section 481.106, Health and Safety Code, is
367367 amended to read as follows:
368368 Sec. 481.106. CLASSIFICATION OF CONTROLLED SUBSTANCE
369369 ANALOGUE. For the purposes of the prosecution of an offense under
370370 this subchapter involving the manufacture, delivery, or possession
371371 of a controlled substance, Penalty Groups 1, 1-A, [and] 2, and 2-A
372372 include a controlled substance analogue that:
373373 (1) has a chemical structure substantially similar to
374374 the chemical structure of a controlled substance listed in the
375375 applicable penalty group; or
376376 (2) is specifically designed to produce an effect
377377 substantially similar to, or greater than, a controlled substance
378378 listed in the applicable penalty group.
379379 SECTION 4. The change in law made by this Act applies only
380380 to an offense committed on or after the effective date of this Act.
381381 An offense committed before the effective date of this Act is
382382 governed by the law in effect on the date the offense was committed,
383383 and the former law is continued in effect for that purpose. For
384384 purposes of this section, an offense was committed before the
385385 effective date of this Act if any element of the offense occurred
386386 before that date.
387387 SECTION 5. This Act takes effect September 1, 2013.
