| 8 | 8 | | relating to the penalty for the offense of leaving the scene of an |

| 9 | 9 | | accident that involves personal injury or death. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subsection (c), Section 550.021, Transportation |
|---|
| 12 | 12 | | Code, is amended to read as follows: |
|---|
| 13 | 13 | | (c) A person commits an offense if the person does not stop |
|---|
| 14 | 14 | | or does not comply with the requirements of this section. An |
|---|
| 15 | 15 | | offense under this section: |
|---|
| 16 | 16 | | (1) involving an accident resulting in: |
|---|
| 17 | 17 | | (A) death of a person is a felony of the second |
|---|
| 18 | 18 | | degree; or |
|---|
| 19 | 19 | | (B) serious bodily injury, as defined by Section |
|---|
| 20 | 20 | | 1.07, Penal Code, to a person is a felony of the third degree; and |
|---|
| 21 | 21 | | (2) involving an accident resulting in injury to which |
|---|
| 22 | 22 | | Subdivision (1) does not apply is punishable by: |
|---|
| 23 | 23 | | (A) imprisonment in the Texas Department of |
|---|
| 24 | 24 | | Criminal Justice for not more than five years or confinement in the |
|---|
| 25 | 25 | | county jail for not more than one year; |
|---|
| 26 | 26 | | (B) a fine not to exceed $5,000; or |
|---|
| 27 | 27 | | (C) both the fine and the imprisonment or |
|---|
| 28 | 28 | | confinement. |
|---|
| 29 | 29 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 30 | 30 | | to an offense committed on or after the effective date of this Act. |
|---|
| 31 | 31 | | An offense committed before the effective date of this Act is |
|---|
| 32 | 32 | | governed by the law in effect on the date the offense was committed, |
|---|
| 33 | 33 | | and the former law is continued in effect for that purpose. For |
|---|
| 34 | 34 | | purposes of this section, an offense was committed before the |
|---|
| 35 | 35 | | effective date of this Act if any element of the offense occurred |
|---|
| 36 | 36 | | before that date. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2013. |
