77 AN ACT
88 relating to the penalty for the offense of leaving the scene of an
99 accident that involves personal injury or death.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (c), Section 550.021, Transportation
1212 Code, is amended to read as follows:
1313 (c) A person commits an offense if the person does not stop
1414 or does not comply with the requirements of this section. An
1515 offense under this section:
1616 (1) involving an accident resulting in:
1717 (A) death of a person is a felony of the second
1818 degree; or
1919 (B) serious bodily injury, as defined by Section
2020 1.07, Penal Code, to a person is a felony of the third degree; and
2121 (2) involving an accident resulting in injury to which
2222 Subdivision (1) does not apply is punishable by:
2323 (A) imprisonment in the Texas Department of
2424 Criminal Justice for not more than five years or confinement in the
2525 county jail for not more than one year;
2626 (B) a fine not to exceed $5,000; or
2727 (C) both the fine and the imprisonment or
2828 confinement.
2929 SECTION 2. The change in law made by this Act applies only
3030 to an offense committed on or after the effective date of this Act.
3131 An offense committed before the effective date of this Act is
3232 governed by the law in effect on the date the offense was committed,
3333 and the former law is continued in effect for that purpose. For
3434 purposes of this section, an offense was committed before the
3535 effective date of this Act if any element of the offense occurred
3636 before that date.
3737 SECTION 3. This Act takes effect September 1, 2013.
