                    BILL ANALYSIS             S.B. 380     By: Schwertner     Public Health     Committee Report (Unamended)             BACKGROUND AND PURPOSE    Recent legislation made certain due process reforms relating to complaints filed with the Texas Medical Board, including authorizing a physician under review by the board to request that a recording of the physician's informal settlement conference proceeding be made at the physician's expense. However, the legislation did not include a provision requiring the board to release the recording to the physician. S.B. 380 seeks to rectify this issue.        RULEMAKING AUTHORITY    It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.       ANALYSIS    S.B. 380 amends the Occupations Code to require the Texas Medical Board, on request by a physician under review by the board, to release a recording of an informal settlement conference proceeding to the physician.       EFFECTIVE DATE    On passage, or, if the bill does not receive the necessary vote, September 1, 2013.
