9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subsection (i), Section 164.003, Occupations | |
11 | 11 | Code, is amended to read as follows: | |
12 | 12 | (i) On request by a physician under review, the board shall | |
13 | 13 | make a recording of the informal settlement conference | |
14 | 14 | proceeding. The recording is a part of the investigative file and | |
15 | 15 | may not be released to a third party unless authorized under this | |
16 | 16 | subtitle. On request of the physician, the board shall release the | |
17 | 17 | recording to the physician. The board may charge the physician a | |
18 | 18 | fee to cover the cost of recording the proceeding. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2013. |
