88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the management and operation of certain municipally
1111 owned electric utilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 552.122, Local Government Code, is
1414 amended by adding Subsection (c) to read as follows:
1515 (c) Notwithstanding any other law, including a municipal
1616 ordinance or provision of a municipal charter, a municipality with
1717 a population of less than 850,000 that is served by a municipally
1818 owned electric utility system with 400,000 or more customers may
1919 transfer management and control of the municipality's electric
2020 utility system to a board of trustees appointed by the
2121 municipality's governing body.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2013.
