12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 552.122, Local Government Code, is |
---|
14 | 14 | | amended by adding Subsection (c) to read as follows: |

15 | 15 | | (c) Notwithstanding any other law, including a municipal |
---|
16 | 16 | | ordinance or provision of a municipal charter, a municipality with |
---|
17 | 17 | | a population of less than 850,000 that is served by a municipally |
---|
18 | 18 | | owned electric utility system with 400,000 or more customers may |
---|
19 | 19 | | transfer management and control of the municipality's electric |
---|
20 | 20 | | utility system to a board of trustees appointed by the |
---|
21 | 21 | | municipality's governing body. |
---|
22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
---|
23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
---|
24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
---|
26 | 26 | | Act takes effect September 1, 2013. |
