8	8	AN ACT
9	9	relating to the Texas System of Care and the development of local
10	10	mental health systems of care for certain children.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. The heading to Subchapter G-1, Chapter 531,
13	13	Government Code, is amended to read as follows:
14	14	SUBCHAPTER G-1. DEVELOPING LOCAL MENTAL HEALTH [CARE] SYSTEMS OF
15	15	CARE FOR CERTAIN CHILDREN
16	16	SECTION 2. Section 531.251, Government Code, is amended to
17	17	read as follows:
18	18	Sec. 531.251. TEXAS SYSTEM OF CARE [PILOT PROJECT]
19	19	CONSORTIUM[; EXPANSION PLAN]. (a) The commission shall form a
20	20	consortium to have responsibility [develop criteria] for and
21	21	oversight over a state system of care [and implement the expansion
22	22	of the Texas Integrated Funding Initiative pilot project and] to
23	23	develop local mental health systems of care [systems] in
24	24	communities for minors who are receiving residential mental health
25	25	services or inpatient mental health hospitalization or who are at
26	26	risk of being removed from the minor's home and placed in a more
27	27	restrictive environment to receive mental health services,
28	28	including an inpatient mental health hospital, a residential
29	29	treatment facility, or a facility or program operated by the
30	30	Department of Family and Protective Services or an agency that is
31	31	part of the juvenile justice system [placement to receive mental
32	32	health services].
33	33	(a-1) The consortium must include:
34	34	(1) representatives of the [Texas] Department of State
35	35	[Mental] Health Services [and Mental Retardation], Department of
36	36	Family and Protective [and Regulatory] Services, Health and Human
37	37	Services Commission's Medicaid program, Texas Education Agency,
38	38	[Texas Youth Commission,] Texas Juvenile Justice Department
39	39	[Probation Commission], and Texas Correctional Office on Offenders
40	40	with Medical or Mental Impairments;
41	41	(2) one youth or young adult who has a serious
42	42	emotional disturbance and has received mental health services and
43	43	supports; or
44	44	(3) a family member of a youth or young adult described
45	45	by Subdivision (2) [Commission on Alcohol and Drug Abuse and an
46	46	equal number of family advocates].
47	47	(a-2) The consortium may coordinate with the Children's
48	48	Policy Council for the purposes of including the representation
49	49	required by Subsections (a-1)(2) and (3).
50	50	(b) The commission and the consortium shall:
51	51	(1) maintain [develop] a comprehensive plan [model and
52	52	guidelines] for the delivery of mental health services and supports
53	53	[support] to a minor and a minor's family using a system of care
54	54	framework [, initiated before the person's 18th birthday],
55	55	including best practices in the financing, administration,
56	56	governance, and delivery of those services;
57	57	(2) implement strategies [establish a plan] to expand
58	58	the use of system of care practices [Texas Integrated Funding
59	59	Initiative so that the initiative may operate] in the planning and
60	60	delivery of services throughout the state [up to six communities];
61	61	[and]
62	62	(3) identify appropriate local, [sources of] state,
63	63	and federal funding sources to finance infrastructure and mental
64	64	health services needed to support state and local system of care
65	65	efforts; and
66	66	(4) develop an evaluation system to measure outcomes
67	67	of state and local system of care efforts [under the initiative from
68	68	a central fund for expansion communities].
69	69	(b-1) Not later than November 1 of each even-numbered year,
70	70	the consortium shall submit a report to the legislature and the
71	71	Council on Children and Families that contains an evaluation of the
72	72	outcomes of the Texas System of Care and recommendations on
73	73	strengthening state policies and practices that support local
74	74	systems of care, including recommendations relating to:
75	75	(1) methods to increase access to effective and
76	76	coordinated services and supports;
77	77	(2) methods to increase community capacity to
78	78	implement local systems of care through training and technical
79	79	assistance;
80	80	(3) use of cross-system performance and outcome data
81	81	to make informed decisions at individual and system levels; and
82	82	(4) strategies to maximize public and private funding
83	83	at the local, state, and federal levels.
84	84	SECTION 3. Section 531.255(a), Government Code, is amended
85	85	to read as follows:
86	86	(a) The commission and the [Texas] Department of State
87	87	[Mental] Health Services [and Mental Retardation] jointly shall
88	88	monitor the progress of the [expansion] communities that implement
89	89	a local system of care, including monitoring cost avoidance and the
90	90	net savings that result from implementing a local system of care.
91	91	SECTION 4. Section 531.257, Government Code, is amended to
92	92	read as follows:
93	93	Sec. 531.257. TECHNICAL ASSISTANCE FOR [GRANT] PROJECTS.
94	94	The commission may provide technical assistance to a community that
95	95	implements a local system of care [receives a grant under Section
96	96	531.256].
97	97	SECTION 5. Sections 531.252, 531.253, 531.254, 531.255(b),
98	98	(c), and (d), 531.256, and 531.258, Government Code, are repealed.
99	99	SECTION 6. This Act takes effect September 1, 2013.
