99 relating to the Texas System of Care and the development of local
1010 mental health systems of care for certain children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Subchapter G-1, Chapter 531,
1313 Government Code, is amended to read as follows:
1414 SUBCHAPTER G-1. DEVELOPING LOCAL MENTAL HEALTH [CARE] SYSTEMS OF
1515 CARE FOR CERTAIN CHILDREN
1616 SECTION 2. Section 531.251, Government Code, is amended to
1717 read as follows:
1818 Sec. 531.251. TEXAS SYSTEM OF CARE [PILOT PROJECT]
1919 CONSORTIUM[; EXPANSION PLAN]. (a) The commission shall form a
2020 consortium to have responsibility [develop criteria] for and
2121 oversight over a state system of care [and implement the expansion
2222 of the Texas Integrated Funding Initiative pilot project and] to
2323 develop local mental health systems of care [systems] in
2424 communities for minors who are receiving residential mental health
2525 services or inpatient mental health hospitalization or who are at
2626 risk of being removed from the minor's home and placed in a more
2727 restrictive environment to receive mental health services,
2828 including an inpatient mental health hospital, a residential
2929 treatment facility, or a facility or program operated by the
3030 Department of Family and Protective Services or an agency that is
3131 part of the juvenile justice system [placement to receive mental
3232 health services].
3333 (a-1) The consortium must include:
3434 (1) representatives of the [Texas] Department of State
3535 [Mental] Health Services [and Mental Retardation], Department of
3636 Family and Protective [and Regulatory] Services, Health and Human
3737 Services Commission's Medicaid program, Texas Education Agency,
3838 [Texas Youth Commission,] Texas Juvenile Justice Department
3939 [Probation Commission], and Texas Correctional Office on Offenders
4040 with Medical or Mental Impairments;
4141 (2) one youth or young adult who has a serious
4242 emotional disturbance and has received mental health services and
4343 supports; or
4444 (3) a family member of a youth or young adult described
4545 by Subdivision (2) [Commission on Alcohol and Drug Abuse and an
4646 equal number of family advocates].
4747 (a-2) The consortium may coordinate with the Children's
4848 Policy Council for the purposes of including the representation
4949 required by Subsections (a-1)(2) and (3).
5050 (b) The commission and the consortium shall:
5151 (1) maintain [develop] a comprehensive plan [model and
5252 guidelines] for the delivery of mental health services and supports
5353 [support] to a minor and a minor's family using a system of care
5454 framework [, initiated before the person's 18th birthday],
5555 including best practices in the financing, administration,
5656 governance, and delivery of those services;
5757 (2) implement strategies [establish a plan] to expand
5858 the use of system of care practices [Texas Integrated Funding
5959 Initiative so that the initiative may operate] in the planning and
6060 delivery of services throughout the state [up to six communities];
6161 [and]
6262 (3) identify appropriate local, [sources of] state,
6363 and federal funding sources to finance infrastructure and mental
6464 health services needed to support state and local system of care
6565 efforts; and
6666 (4) develop an evaluation system to measure outcomes
6767 of state and local system of care efforts [under the initiative from
6868 a central fund for expansion communities].
6969 (b-1) Not later than November 1 of each even-numbered year,
7070 the consortium shall submit a report to the legislature and the
7171 Council on Children and Families that contains an evaluation of the
7272 outcomes of the Texas System of Care and recommendations on
7373 strengthening state policies and practices that support local
7474 systems of care, including recommendations relating to:
7575 (1) methods to increase access to effective and
7676 coordinated services and supports;
7777 (2) methods to increase community capacity to
7878 implement local systems of care through training and technical
7979 assistance;
8080 (3) use of cross-system performance and outcome data
8181 to make informed decisions at individual and system levels; and
8282 (4) strategies to maximize public and private funding
8383 at the local, state, and federal levels.
8484 SECTION 3. Section 531.255(a), Government Code, is amended
8585 to read as follows:
8686 (a) The commission and the [Texas] Department of State
8787 [Mental] Health Services [and Mental Retardation] jointly shall
8888 monitor the progress of the [expansion] communities that implement
8989 a local system of care, including monitoring cost avoidance and the
9090 net savings that result from implementing a local system of care.
9191 SECTION 4. Section 531.257, Government Code, is amended to
9292 read as follows:
9393 Sec. 531.257. TECHNICAL ASSISTANCE FOR [GRANT] PROJECTS.
9494 The commission may provide technical assistance to a community that
9595 implements a local system of care [receives a grant under Section
9696 531.256].
9797 SECTION 5. Sections 531.252, 531.253, 531.254, 531.255(b),
9898 (c), and (d), 531.256, and 531.258, Government Code, are repealed.
9999 SECTION 6. This Act takes effect September 1, 2013.
