11	11	AN ACT
12	12	relating to the audit of certain river authorities.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. AUDIT. Chapter 321, Government Code, is amended
15	15	by adding Section 321.024 to read as follows:
16	16	Sec. 321.024. CERTAIN RIVER AUTHORITIES SUBJECT TO AUDIT.
17	17	(a) A river authority listed in Subsection (b) is subject to audit
18	18	under this chapter as if it were a state agency.
19	19	(b) This section applies only to the:
20	20	(1) Brazos River Authority; and
21	21	(2) Lower Colorado River Authority.
22	22	(c) A river authority shall pay the cost incurred by the
23	23	state auditor in conducting an audit of the authority under this
24	24	section. The state auditor shall determine the cost, and the
25	25	authority shall pay the amount promptly on receipt of a statement
26	26	from the state auditor detailing the cost.
27	27	SECTION 2. BRAZOS RIVER AUTHORITY. Chapter 8502, Special
28	28	District Local Laws Code, is amended by adding Section 8502.0051 to
29	29	read as follows:
30	30	Sec. 8502.0051. AUDIT. The authority is subject to the
31	31	audit provisions of Section 321.024, Government Code.
32	32	SECTION 3. LOWER COLORADO RIVER AUTHORITY. Section
33	33	8503.015, Special District Local Laws Code, is amended to read as
34	34	follows:
35	35	Sec. 8503.015. AUDIT. The authority is subject to the audit
36	36	provisions of:
37	37	(1) Subchapter G, Chapter 49, Water Code; and
38	38	(2) Section 321.024, Government Code.
39	39	SECTION 4. TRANSITION. (a) Subject to approval by the
40	40	Legislative Audit Committee for inclusion in the audit plan under
41	41	Subsection (c), Section 321.013, Government Code, the state auditor
42	42	shall conduct comprehensive audits, including audits of the
43	43	operations and performance, of the Brazos River Authority and the
44	44	Lower Colorado River Authority under Section 321.024, Government
45	45	Code, as added by this Act.
46	46	(b) A river authority audited under this section shall
47	47	cooperate and provide assistance and access to all necessary
48	48	records, confidential or nonconfidential, to the state auditor in
49	49	conducting the audit under this section.
50	50	(c) Not later than December 31, 2015, the state auditor
51	51	shall prepare a written report for an audit conducted under this
52	52	section and file the report in accordance with Section 321.014,
53	53	Government Code.
54	54	SECTION 5. EFFECTIVE DATE. This Act takes effect
55	55	immediately if it receives a vote of two-thirds of all the members
56	56	elected to each house, as provided by Section 39, Article III, Texas
57	57	Constitution. If this Act does not receive the vote necessary for
58	58	immediate effect, this Act takes effect September 1, 2013.
