| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (a), Section 552.001, Occupations |
|---|
| 10 | 10 | | Code, is amended to read as follows: |
|---|
| 11 | 11 | | (a) The Texas State Board of Pharmacy consists of 11 [nine] |
|---|
| 12 | 12 | | members appointed by the governor with the advice and consent of the |
|---|
| 13 | 13 | | senate as follows: |
|---|
| 14 | 14 | | (1) seven [six] members who are pharmacists; [and] |
|---|
| 15 | 15 | | (2) one member who is a pharmacy technician; and |
|---|
| 16 | 16 | | (3) three members who represent the public. |
|---|
| 17 | 17 | | SECTION 2. Section 552.002, Occupations Code, is amended by |
|---|
| 18 | 18 | | adding Subsection (b-1) to read as follows: |
|---|
| 19 | 19 | | (b-1) A pharmacy technician board member must, at the time |
|---|
| 20 | 20 | | of appointment: |
|---|
| 21 | 21 | | (1) be a resident of this state; |
|---|
| 22 | 22 | | (2) have been registered as a pharmacy technician for |
|---|
| 23 | 23 | | the five years preceding appointment; |
|---|
| 24 | 24 | | (3) be in good standing to act as a pharmacy technician |
|---|
| 25 | 25 | | in this state; and |
|---|
| 26 | 26 | | (4) be acting as a pharmacy technician in this state. |
|---|
| 27 | 27 | | SECTION 3. Subsection (a), Section 552.005, Occupations |
|---|
| 28 | 28 | | Code, is amended to read as follows: |
|---|
| 29 | 29 | | (a) Members of the board are appointed for staggered |
|---|
| 30 | 30 | | six-year terms, with either[. The terms of] three or four members' |
|---|
| 31 | 31 | | terms, as applicable, expiring [members expire] every other year at |
|---|
| 32 | 32 | | midnight on the last day of the state fiscal year in the last year of |
|---|
| 33 | 33 | | the member's term. |
|---|
| 34 | 34 | | SECTION 4. Subsection (a), Section 552.010, Occupations |
|---|
| 35 | 35 | | Code, is amended to read as follows: |
|---|
| 36 | 36 | | (a) The board shall meet at least[: |
|---|
| 37 | 37 | | [(1)] once every four months to transact board |
|---|
| 38 | 38 | | business[; and |
|---|
| 39 | 39 | | [(2) twice each year for the examination of |
|---|
| 40 | 40 | | applicants]. |
|---|
| 41 | 41 | | SECTION 5. As soon as practicable after the effective date |
|---|
| 42 | 42 | | of this Act, the governor shall appoint a pharmacy technician and a |
|---|
| 43 | 43 | | pharmacist to the Texas State Board of Pharmacy as required by this |
|---|
| 44 | 44 | | Act. In appointing the members, the governor shall appoint: |
|---|
| 45 | 45 | | (1) a pharmacy technician to a term expiring August |
|---|
| 46 | 46 | | 31, 2019; and |
|---|
| 47 | 47 | | (2) a pharmacist to a term expiring August 31, 2017. |
|---|
| 48 | 48 | | SECTION 6. This Act takes effect September 1, 2013. |
