77 relating to an exemption from the licensing requirement for certain
88 persons who measure or fit orthoses under the supervision of a
99 physician.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter G, Chapter 605, Occupations Code, is
1212 amended by adding Section 605.306 to read as follows:
1313 Sec. 605.306. EXEMPTION FOR CERTAIN SUPERVISED PERSONS.
1414 (a) This chapter does not apply to a person who measures or fits an
1515 orthosis under the supervision of a physician practicing under
1616 Subtitle B.
1717 (b) The exemption provided by this section does not apply to
1818 the measuring and fitting of a custom-fabricated device if the
1919 measuring and fitting requires substantial clinical judgment as
2020 determined by the treating physician.
2121 SECTION 2. This Act takes effect immediately if it receives
2222 a vote of two-thirds of all the members elected to each house, as
2323 provided by Section 39, Article III, Texas Constitution. If this
2424 Act does not receive the vote necessary for immediate effect, this
2525 Act takes effect September 1, 2013.
