| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter G, Chapter 605, Occupations Code, is | |
| 12 | 12 | amended by adding Section 605.306 to read as follows: | |
| 13 | 13 | Sec. 605.306. EXEMPTION FOR CERTAIN SUPERVISED PERSONS. | |
| 14 | 14 | (a) This chapter does not apply to a person who measures or fits an | |
| 15 | 15 | orthosis under the supervision of a physician practicing under | |
| 16 | 16 | Subtitle B. | |
| 17 | 17 | (b) The exemption provided by this section does not apply to | |
| 18 | 18 | the measuring and fitting of a custom-fabricated device if the | |
| 19 | 19 | measuring and fitting requires substantial clinical judgment as | |
| 20 | 20 | determined by the treating physician. | |
| 21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
| 22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
| 23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
| 24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
| 25 | 25 | Act takes effect September 1, 2013. |
