77 relating to the authority of the Midland County Hospital District
88 of Midland County, Texas, to employ and commission peace officers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 1061, Special District
1111 Local Laws Code, is amended by adding Section 1061.121 to read as
1212 follows:
1313 Sec. 1061.121. EMPLOYMENT OF DISTRICT PEACE OFFICERS.
1414 (a) The board may employ and commission peace officers for the
1515 district.
1616 (b) The jurisdiction of a peace officer commissioned under
1717 this section includes the property owned or controlled by the
1818 district.
1919 (c) In a district peace officer's jurisdiction, the peace
2020 officer has the authority granted by Chapter 14, Code of Criminal
2121 Procedure.
2222 SECTION 2. Article 2.12, Code of Criminal Procedure, is
2323 amended to read as follows:
2424 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
2525 officers:
2626 (1) sheriffs, their deputies, and those reserve
2727 deputies who hold a permanent peace officer license issued under
2828 Chapter 1701, Occupations Code;
2929 (2) constables, deputy constables, and those reserve
3030 deputy constables who hold a permanent peace officer license issued
3131 under Chapter 1701, Occupations Code;
3232 (3) marshals or police officers of an incorporated
3333 city, town, or village, and those reserve municipal police officers
3434 who hold a permanent peace officer license issued under Chapter
3535 1701, Occupations Code;
3636 (4) rangers and officers commissioned by the Public
3737 Safety Commission and the Director of the Department of Public
3838 Safety;
3939 (5) investigators of the district attorneys', criminal
4040 district attorneys', and county attorneys' offices;
4141 (6) law enforcement agents of the Texas Alcoholic
4242 Beverage Commission;
4343 (7) each member of an arson investigating unit
4444 commissioned by a city, a county, or the state;
4545 (8) officers commissioned under Section 37.081,
4646 Education Code, or Subchapter E, Chapter 51, Education Code;
4747 (9) officers commissioned by the General Services
4848 Commission;
4949 (10) law enforcement officers commissioned by the
5050 Parks and Wildlife Commission;
5151 (11) airport police officers commissioned by a city
5252 with a population of more than 1.18 million located primarily in a
5353 county with a population of 2 million or more that operates an
5454 airport that serves commercial air carriers;
5555 (12) airport security personnel commissioned as peace
5656 officers by the governing body of any political subdivision of this
5757 state, other than a city described by Subdivision (11), that
5858 operates an airport that serves commercial air carriers;
5959 (13) municipal park and recreational patrolmen and
6060 security officers;
6161 (14) security officers and investigators commissioned
6262 as peace officers by the comptroller;
6363 (15) officers commissioned by a water control and
6464 improvement district under Section 49.216, Water Code;
6565 (16) officers commissioned by a board of trustees
6666 under Chapter 54, Transportation Code;
6767 (17) investigators commissioned by the Texas Medical
6868 Board;
6969 (18) officers commissioned by:
7070 (A) the board of managers of the Dallas County
7171 Hospital District, the Tarrant County Hospital District, the Bexar
7272 County Hospital District, or the El Paso County Hospital District
7373 under Section 281.057, Health and Safety Code; [and]
7474 (B) the board of directors of the Ector County
7575 Hospital District under Section 1024.117, Special District Local
7676 Laws Code; and
7777 (C) the board of directors of the Midland County
7878 Hospital District of Midland County, Texas, under Section 1061.121,
7979 Special District Local Laws Code;
8080 (19) county park rangers commissioned under
8181 Subchapter E, Chapter 351, Local Government Code;
8282 (20) investigators employed by the Texas Racing
8383 Commission;
8484 (21) officers commissioned under Chapter 554,
8585 Occupations Code;
8686 (22) officers commissioned by the governing body of a
8787 metropolitan rapid transit authority under Section 451.108,
8888 Transportation Code, or by a regional transportation authority
8989 under Section 452.110, Transportation Code;
9090 (23) investigators commissioned by the attorney
9191 general under Section 402.009, Government Code;
9292 (24) security officers and investigators commissioned
9393 as peace officers under Chapter 466, Government Code;
9494 (25) an officer employed by the Department of State
9595 Health Services under Section 431.2471, Health and Safety Code;
9696 (26) officers appointed by an appellate court under
9797 Subchapter F, Chapter 53, Government Code;
9898 (27) officers commissioned by the state fire marshal
9999 under Chapter 417, Government Code;
100100 (28) an investigator commissioned by the commissioner
101101 of insurance under Section 701.104, Insurance Code;
102102 (29) apprehension specialists and inspectors general
103103 commissioned by the Texas Juvenile Justice Department as officers
104104 under Sections 242.102 and 243.052, Human Resources Code;
105105 (30) officers appointed by the inspector general of
106106 the Texas Department of Criminal Justice under Section 493.019,
107107 Government Code;
108108 (31) investigators commissioned by the Commission on
109109 Law Enforcement Officer Standards and Education under Section
110110 1701.160, Occupations Code;
111111 (32) commission investigators commissioned by the
112112 Texas Private Security Board under Section 1702.061(f),
113113 Occupations Code;
114114 (33) the fire marshal and any officers, inspectors, or
115115 investigators commissioned by an emergency services district under
116116 Chapter 775, Health and Safety Code;
117117 (34) officers commissioned by the State Board of
118118 Dental Examiners under Section 254.013, Occupations Code, subject
119119 to the limitations imposed by that section;
120120 (35) investigators commissioned by the Texas Juvenile
121121 Justice Department as officers under Section 221.011, Human
122122 Resources Code; and
123123 (36) the fire marshal and any related officers,
124124 inspectors, or investigators commissioned by a county under
125125 Subchapter B, Chapter 352, Local Government Code.
126126 SECTION 3. This Act takes effect immediately if it receives
127127 a vote of two-thirds of all the members elected to each house, as
128128 provided by Section 39, Article III, Texas Constitution. If this
129129 Act does not receive the vote necessary for immediate effect, this
130130 Act takes effect September 1, 2013.
