66 AN ACT
77 relating to the penalty for theft of an official ballot or official
88 carrier envelope for an election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (e), Section 31.03, Penal Code, is
1111 amended to read as follows:
1212 (e) Except as provided by Subsection (f), an offense under
1313 this section is:
1414 (1) a Class C misdemeanor if the value of the property
1515 stolen is less than:
1616 (A) $50; or
1717 (B) $20 and the defendant obtained the property
1818 by issuing or passing a check or similar sight order in a manner
1919 described by Section 31.06;
2020 (2) a Class B misdemeanor if:
2121 (A) the value of the property stolen is:
2222 (i) $50 or more but less than $500; or
2323 (ii) $20 or more but less than $500 and the
2424 defendant obtained the property by issuing or passing a check or
2525 similar sight order in a manner described by Section 31.06;
2626 (B) the value of the property stolen is less
2727 than:
2828 (i) $50 and the defendant has previously
2929 been convicted of any grade of theft; or
3030 (ii) $20, the defendant has previously been
3131 convicted of any grade of theft, and the defendant obtained the
3232 property by issuing or passing a check or similar sight order in a
3333 manner described by Section 31.06; or
3434 (C) the property stolen is a driver's license,
3535 commercial driver's license, or personal identification
3636 certificate issued by this state or another state;
3737 (3) a Class A misdemeanor if the value of the property
3838 stolen is $500 or more but less than $1,500;
3939 (4) a state jail felony if:
4040 (A) the value of the property stolen is $1,500 or
4141 more but less than $20,000, or the property is less than 10 head of
4242 sheep, swine, or goats or any part thereof under the value of
4343 $20,000;
4444 (B) regardless of value, the property is stolen
4545 from the person of another or from a human corpse or grave,
4646 including property that is a military grave marker;
4747 (C) the property stolen is a firearm, as defined
4848 by Section 46.01;
4949 (D) the value of the property stolen is less than
5050 $1,500 and the defendant has been previously convicted two or more
5151 times of any grade of theft; or
5252 (E) [the property stolen is an official ballot or
5353 official carrier envelope for an election; or
5454 [(F)] the value of the property stolen is less
5555 than $20,000 and the property stolen is:
5656 (i) aluminum;
5757 (ii) bronze;
5858 (iii) copper; or
5959 (iv) brass;
6060 (5) a felony of the third degree if the value of the
6161 property stolen is $20,000 or more but less than $100,000, or the
6262 property is:
6363 (A) cattle, horses, or exotic livestock or exotic
6464 fowl as defined by Section 142.001, Agriculture Code, stolen during
6565 a single transaction and having an aggregate value of less than
6666 $100,000; [or]
6767 (B) 10 or more head of sheep, swine, or goats
6868 stolen during a single transaction and having an aggregate value of
6969 less than $100,000; or
7070 (C) an official ballot or official carrier
7171 envelope for an election;
7272 (6) a felony of the second degree if:
7373 (A) the value of the property stolen is $100,000
7474 or more but less than $200,000; or
7575 (B) the value of the property stolen is less than
7676 $200,000 and the property stolen is an automated teller machine or
7777 the contents or components of an automated teller machine; or
7878 (7) a felony of the first degree if the value of the
7979 property stolen is $200,000 or more.
8080 SECTION 2. The change in law made by this Act applies only
8181 to an offense committed on or after the effective date of this Act.
8282 An offense committed before the effective date of this Act is
8383 covered by the law in effect when the offense was committed, and the
8484 former law is continued in effect for that purpose. For purposes of
8585 this section, an offense is committed before the effective date of
8686 this Act if any element of the offense occurs before that date.
8787 SECTION 3. This Act takes effect September 1, 2013.
