77 relating to procedures for securing the deposit of public funds.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2257.045, Government Code, is amended to
1010 read as follows:
1111 Sec. 2257.045. RECEIPT OF SECURITY BY CUSTODIAN. (a) On
1212 receipt of an investment security, a custodian shall[:
1313 [(1)] immediately identify on its books and records,
1414 by book entry or another method, the pledge of the security to the
1515 public entity.
1616 (b) For a deposit of public funds under Subchapter F, the
1717 custodian shall issue and deliver to the comptroller a trust
1818 receipt for the pledged security.
1919 (c) For any other deposit of public funds under this
2020 chapter, at the written direction of the appropriate public entity
2121 officer, the custodian shall:
2222 (1) [; and
2323 [(2) promptly] issue and deliver to the appropriate
2424 public entity officer a trust receipt for the pledged security; or
2525 (2) issue and deliver a trust receipt for the pledged
2626 security to the public entity's depository and instruct the
2727 depository to deliver the trust receipt to the public entity
2828 officer immediately.
2929 (d) The custodian shall issue and deliver the trust receipt
3030 as soon as practicable on the same business day on which the
3131 investment security is received.
3232 SECTION 2. Section 2257.046, Government Code, is amended by
3333 adding Subsection (d) to read as follows:
3434 (d) At the request of the appropriate public entity officer,
3535 the public entity's custodian shall provide a current list of all
3636 pledged investment securities. The list must include, for each
3737 pledged investment security:
3838 (1) the name of the public entity;
3939 (2) the date the security was pledged to secure the
4040 public entity's deposit;
4141 (3) the Committee on Uniform Security Identification
4242 Procedures (CUSIP) number of the security;
4343 (4) the face value and maturity date of the security;
4444 and
4545 (5) the confirmation number on the trust receipt
4646 issued by the custodian.
4747 SECTION 3. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2013.
