99 AN ACT
1010 relating to the powers and duties of the Hidalgo County Water
1111 Control and Improvement District No. 19; providing authority to
1212 issue bonds; providing authority to impose fees and taxes.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 9044 to read as follows:
1616 CHAPTER 9044. HIDALGO COUNTY WATER CONTROL AND IMPROVEMENT
1717 DISTRICT NO. 19
1818 SUBCHAPTER A. GENERAL PROVISIONS
1919 Sec. 9044.001. DEFINITION. In this chapter, "district"
2020 means the Hidalgo County Water Control and Improvement District No.
2121 19.
2222 Sec. 9044.002. NATURE AND PURPOSES OF DISTRICT. (a) The
2323 district is a water control and improvement district created under
2424 Section 59, Article XVI, Texas Constitution.
2525 (b) The district is created to accomplish the purposes of:
2626 (1) a water control and improvement district as
2727 provided by general law and Section 59, Article XVI, Texas
2828 Constitution; and
2929 (2) Section 52, Article III, Texas Constitution, that
3030 relate to the construction, acquisition, improvement, operation,
3131 or maintenance of macadamized, graveled, or paved roads, or
3232 improvements, including storm drainage, in aid of those roads.
3333 SUBCHAPTER B. POWERS AND DUTIES
3434 Sec. 9044.051. GENERAL POWERS AND DUTIES. The district has
3535 the powers and duties necessary to accomplish the purposes for
3636 which the district is created.
3737 Sec. 9044.052. WATER CONTROL AND IMPROVEMENT DISTRICT
3838 POWERS AND DUTIES. The district has the powers and duties provided
3939 by the general law of this state, including Chapters 49 and 51,
4040 Water Code, applicable to water control and improvement districts
4141 created under Section 59, Article XVI, Texas Constitution.
4242 Sec. 9044.053. AUTHORITY FOR ROAD PROJECTS. Under Section
4343 52, Article III, Texas Constitution, the district may design,
4444 acquire, construct, finance, issue bonds for, improve, operate,
4545 maintain, and convey to this state, a county, or a municipality for
4646 operation and maintenance macadamized, graveled, or paved roads, or
4747 improvements, including storm drainage, in aid of those roads.
4848 Sec. 9044.054. ROAD STANDARDS AND REQUIREMENTS. (a) A
4949 road project must meet all applicable construction standards,
5050 zoning and subdivision requirements, and regulations of each
5151 municipality in whose corporate limits or extraterritorial
5252 jurisdiction the road project is located.
5353 (b) If a road project is not located in the corporate limits
5454 or extraterritorial jurisdiction of a municipality, the road
5555 project must meet all applicable construction standards,
5656 subdivision requirements, and regulations of each county in which
5757 the road project is located.
5858 (c) If the state will maintain and operate the road, the
5959 Texas Transportation Commission must approve the plans and
6060 specifications of the road project.
6161 Sec. 9044.055. DIVISION OF DISTRICT. (a) The district may
6262 be divided into two or more new districts only if the district:
6363 (1) has no outstanding bonded debt; and
6464 (2) is not imposing ad valorem taxes.
6565 (b) This chapter applies to any new district created by the
6666 division of the district, and a new district has all the powers and
6767 duties of the district.
6868 (c) Any new district created by the division of the district
6969 may not, at the time the new district is created, contain any land
7070 outside the district as of the effective date of the Act enacting
7171 this chapter.
7272 (d) The district's board of directors, on its own motion or
7373 on receipt of a petition signed by the owner or owners of a majority
7474 of the assessed value of the real property in the district, may
7575 adopt an order dividing the district.
7676 (e) An order dividing the district must:
7777 (1) name each new district;
7878 (2) include the metes and bounds description of the
7979 territory of each new district;
8080 (3) appoint temporary directors serving staggered
8181 four-year terms for each new district; and
8282 (4) provide for the division of assets and liabilities
8383 between or among the new districts.
8484 (f) On or before the 30th day after the date of adoption of
8585 an order dividing the district, the district shall file the order
8686 with the Texas Commission on Environmental Quality and record the
8787 order in the real property records of each county in which the
8888 district is located.
8989 (g) A new district created by the division of the district
9090 is not required to hold a confirmation election.
9191 (h) The consent of a municipality or county is not required
9292 for the creation of any new district under this section if the new
9393 district's creation complies with Subsection (c).
9494 (i) A new district created by the division of the district
9595 must hold an election to obtain voter approval before the district
9696 may impose a maintenance tax or issue bonds payable wholly or partly
9797 from ad valorem taxes.
9898 SUBCHAPTER C. BONDS AND OTHER OBLIGATIONS
9999 Sec. 9044.101. AUTHORITY TO ISSUE BONDS AND OTHER
100100 OBLIGATIONS FOR ROAD PROJECTS. (a) The district may issue bonds
101101 or other obligations payable wholly or partly from ad valorem
102102 taxes, impact fees, revenue, contract payments, grants, or other
103103 district money, or any combination of those sources, to pay for a
104104 road project authorized by Section 9044.053.
105105 (b) The district may not issue bonds payable from ad valorem
106106 taxes to finance a road project unless the issuance is approved by a
107107 vote of a two-thirds majority of the district voters voting at an
108108 election held for that purpose.
109109 (c) At the time of issuance, the total principal amount of
110110 bonds or other obligations issued or incurred to finance road
111111 projects and payable from ad valorem taxes may not exceed
112112 one-fourth of the assessed value of real property in the district.
113113 Sec. 9044.102. TAXES FOR BONDS. At the time the district
114114 issues bonds payable wholly or partly from ad valorem taxes, the
115115 board shall provide for the annual imposition of a continuing
116116 direct ad valorem tax, without limit as to rate or amount, while all
117117 or part of the bonds are outstanding.
118118 SECTION 2. The Hidalgo County Water Control and Improvement
119119 District No. 19 retains all the rights, powers, privileges,
120120 authority, duties, and functions that it had before the effective
121121 date of this Act.
122122 SECTION 3. (a) The legislature validates and confirms all
123123 governmental acts and proceedings of the Hidalgo County Water
124124 Control and Improvement District No. 19 that were taken before the
125125 effective date of this Act.
126126 (b) This section does not apply to any matter that on the
127127 effective date of this Act:
128128 (1) is involved in litigation if the litigation
129129 ultimately results in the matter being held invalid by a final court
130130 judgment; or
131131 (2) has been held invalid by a final court judgment.
132132 SECTION 4. (a) The legal notice of the intention to
133133 introduce this Act, setting forth the general substance of this
134134 Act, has been published as provided by law, and the notice and a
135135 copy of this Act have been furnished to all persons, agencies,
136136 officials, or entities to which they are required to be furnished
137137 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
138138 Government Code.
139139 (b) The governor, one of the required recipients, has
140140 submitted the notice and Act to the Texas Commission on
141141 Environmental Quality.
142142 (c) The Texas Commission on Environmental Quality has filed
143143 its recommendations relating to this Act with the governor, the
144144 lieutenant governor, and the speaker of the house of
145145 representatives within the required time.
146146 (d) All requirements of the constitution and laws of this
147147 state and the rules and procedures of the legislature with respect
148148 to the notice, introduction, and passage of this Act are fulfilled
149149 and accomplished.
150150 SECTION 5. This Act takes effect immediately if it receives
151151 a vote of two-thirds of all the members elected to each house, as
152152 provided by Section 39, Article III, Texas Constitution. If this
153153 Act does not receive the vote necessary for immediate effect, this
154154 Act takes effect September 1, 2013.
