66 AN ACT
77 relating to regulating faulty on-site sewage disposal systems in
88 the unincorporated areas of a county as a public nuisance;
99 providing a criminal penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subsection (c), Section 343.011, Health and
1212 Safety Code, is amended to read as follows:
1313 (c) A public nuisance is:
1414 (1) keeping, storing, or accumulating refuse on
1515 premises in a neighborhood unless the refuse is entirely contained
1616 in a closed receptacle;
1717 (2) keeping, storing, or accumulating rubbish,
1818 including newspapers, abandoned vehicles, refrigerators, stoves,
1919 furniture, tires, and cans, on premises in a neighborhood or within
2020 300 feet of a public street for 10 days or more, unless the rubbish
2121 or object is completely enclosed in a building or is not visible
2222 from a public street;
2323 (3) maintaining premises in a manner that creates an
2424 unsanitary condition likely to attract or harbor mosquitoes,
2525 rodents, vermin, or disease-carrying pests;
2626 (4) allowing weeds to grow on premises in a
2727 neighborhood if the weeds are located within 300 feet of another
2828 residence or commercial establishment;
2929 (5) maintaining a building in a manner that is
3030 structurally unsafe or constitutes a hazard to safety, health, or
3131 public welfare because of inadequate maintenance, unsanitary
3232 conditions, dilapidation, obsolescence, disaster, damage, or
3333 abandonment or because it constitutes a fire hazard;
3434 (6) maintaining on abandoned and unoccupied property
3535 in a neighborhood a swimming pool that is not protected with:
3636 (A) a fence that is at least four feet high and
3737 that has a latched and locked gate; and
3838 (B) a cover over the entire swimming pool that
3939 cannot be removed by a child;
4040 (7) maintaining on any property in a neighborhood in a
4141 county with a population of more than 1.1 million a swimming pool
4242 that is not protected with:
4343 (A) a fence that is at least four feet high and
4444 that has a latched gate that cannot be opened by a child; or
4545 (B) a cover over the entire swimming pool that
4646 cannot be removed by a child;
4747 (8) maintaining a flea market in a manner that
4848 constitutes a fire hazard;
4949 (9) discarding refuse or creating a hazardous visual
5050 obstruction on:
5151 (A) county-owned land; or
5252 (B) land or easements owned or held by a special
5353 district that has the commissioners court of the county as its
5454 governing body;
5555 (10) discarding refuse on the smaller of:
5656 (A) the area that spans 20 feet on each side of a
5757 utility line; or
5858 (B) the actual span of the utility easement;
5959 (11) filling or blocking a drainage easement, failing
6060 to maintain a drainage easement, maintaining a drainage easement in
6161 a manner that allows the easement to be clogged with debris,
6262 sediment, or vegetation, or violating an agreement with the county
6363 to improve or maintain a drainage easement; [or]
6464 (12) discarding refuse on property that is not
6565 authorized for that activity; or
6666 (13) surface discharge from an on-site sewage disposal
6767 system as defined by Section 366.002.
6868 SECTION 2. Section 343.021, Health and Safety Code, is
6969 amended to read as follows:
7070 Sec. 343.021. AUTHORITY TO ABATE NUISANCE. (a) If a
7171 county adopts abatement procedures that are consistent with the
7272 general purpose of this chapter and that conform to this chapter,
7373 the county may abate a nuisance under this chapter:
7474 (1) by demolition or removal, except as provided by
7575 Subsection (b);
7676 (2) in the case of a nuisance under Section
7777 343.011(c)(1), (9), or (10), by prohibiting or controlling access
7878 to the premises;
7979 (3) in the case of a nuisance under Section
8080 343.011(c)(6), by:
8181 (A) prohibiting or controlling access to the
8282 premises and installing a cover that cannot be opened by a child
8383 over the entire swimming pool; or
8484 (B) draining and filling the swimming pool; or
8585 (4) in the case of a nuisance under Section
8686 343.011(c)(12), by removal, remediation, storage, transportation,
8787 disposal, or other means of waste management authorized under
8888 Chapter 361.
8989 (b) In the case of a nuisance under Section 343.011(c)(13),
9090 the county may use any means of abatement reasonably necessary to
9191 bring the system into compliance with Chapter 366 only after the
9292 defendant fails to abate the nuisance as ordered by the court under
9393 Section 343.012(e).
9494 SECTION 3. This Act takes effect September 1, 2013.
