11 | 11 | amended by adding Section 1.004 to read as follows: | |
12 | 12 | Sec. 1.004. LIMITATION ON EXERCISE OF EMINENT DOMAIN POWER. | |
13 | 13 | An entity governed by Title 6 and authorized by law to exercise the | |
14 | 14 | power of eminent domain may only exercise the power for a public use | |
15 | 15 | in accordance with Section 17, Article I, Texas Constitution. | |
16 | 16 | SECTION 2. Chapter 1, Water Code, is amended by adding | |
17 | 17 | Section 1.005 to read as follows: | |
18 | 18 | Sec. 1.005. LIMITATION ON EXERCISE OF EMINENT DOMAIN POWER. | |
19 | 19 | An entity governed by this code and authorized by law to exercise | |
20 | 20 | the power of eminent domain may only exercise the power for a public | |
21 | 21 | use in accordance with Section 17, Article I, Texas Constitution. | |
22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2013. |
