7 | 7 | | relating to the copying of certain records and files relating to a |

8 | 8 | | child who is a party to a juvenile proceeding. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subsection (b), Section 58.007, Family Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) Except as provided by Article 15.27, Code of Criminal |
---|
13 | 13 | | Procedure, the records and files of a juvenile court, a clerk of |
---|
14 | 14 | | court, a juvenile probation department, or a prosecuting attorney |
---|
15 | 15 | | relating to a child who is a party to a proceeding under this title |
---|
16 | 16 | | may be inspected or copied [are open to inspection] only by: |
---|
17 | 17 | | (1) the judge, probation officers, and professional |
---|
18 | 18 | | staff or consultants of the juvenile court; |
---|
19 | 19 | | (2) a juvenile justice agency as that term is defined |
---|
20 | 20 | | by Section 58.101; |
---|
21 | 21 | | (3) an attorney for a party to the proceeding; |
---|
22 | 22 | | (4) a public or private agency or institution |
---|
23 | 23 | | providing supervision of the child by arrangement of the juvenile |
---|
24 | 24 | | court, or having custody of the child under juvenile court order; or |
---|
25 | 25 | | (5) with leave of the juvenile court, any other |
---|
26 | 26 | | person, agency, or institution having a legitimate interest in the |
---|
27 | 27 | | proceeding or in the work of the court. |
---|
28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
---|
29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
---|
30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
---|
32 | 32 | | Act takes effect September 1, 2013. |
