9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 716.004, Health and Safety Code, is | |
11 | 11 | amended by adding Subsection (b) to read as follows: | |
12 | 12 | (b) The county medical examiner, or, in counties that do not | |
13 | 13 | have a county medical examiner, justices of the peace, shall | |
14 | 14 | develop and maintain a written policy for requesting a written | |
15 | 15 | waiver of the 48-hour waiting period before cremation. In | |
16 | 16 | developing the policy, the medical examiner or justices of the | |
17 | 17 | peace shall consider how persons may make a request, the | |
18 | 18 | availability to make a request on weekends or holidays, and other | |
19 | 19 | issues relevant to processing a request as swiftly as possible. | |
20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
24 | 24 | Act takes effect September 1, 2013. |
