99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 716.004, Health and Safety Code, is
1111 amended by adding Subsection (b) to read as follows:
1212 (b) The county medical examiner, or, in counties that do not
1313 have a county medical examiner, justices of the peace, shall
1414 develop and maintain a written policy for requesting a written
1515 waiver of the 48-hour waiting period before cremation. In
1616 developing the policy, the medical examiner or justices of the
1717 peace shall consider how persons may make a request, the
1818 availability to make a request on weekends or holidays, and other
1919 issues relevant to processing a request as swiftly as possible.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2013.
