| 8 | 8 | | Benbrook Water Authority. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subsection (c), Section 3, Chapter 123, Acts of |
|---|
| 11 | 11 | | the 54th Legislature, Regular Session, 1955, is amended to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (c) Regular [A regular election for the election of |
|---|
| 14 | 14 | | Directors shall be held on the first Saturday in April of each year |
|---|
| 15 | 15 | | after 1969 and before 1994. After 1993, regular] elections for the |
|---|
| 16 | 16 | | election of the appropriate number of Directors must be held on the |
|---|
| 17 | 17 | | [a] uniform date in November of each odd-numbered year or another |
|---|
| 18 | 18 | | date authorized by law and are governed by Chapters 49 and 51, Water |
|---|
| 19 | 19 | | Code. The regular elections shall be called by the Board of |
|---|
| 20 | 20 | | Directors. The Board shall appoint the presiding judge who shall |
|---|
| 21 | 21 | | appoint an assistant judge and at least two (2) clerks. Notice |
|---|
| 22 | 22 | | shall be given the same as is provided for the first election of |
|---|
| 23 | 23 | | Directors. Only qualified voters residing in the Authority are |
|---|
| 24 | 24 | | entitled to vote at an election of Directors. Directors serve |
|---|
| 25 | 25 | | staggered four-year terms, with two or three Directors' terms |
|---|
| 26 | 26 | | expiring each odd-numbered year on the date the successors qualify. |

| 27 | 27 | | [After 1969 and before 1997, in even-numbered years the two (2) |
|---|
| 28 | 28 | | candidates receiving the highest number of votes shall be elected |
|---|
| 29 | 29 | | to serve for a period of two years and in odd-numbered years the |
|---|
| 30 | 30 | | three (3) candidates receiving the highest number of votes shall be |
|---|
| 31 | 31 | | elected to serve for two (2) years. Three Directors shall be |
|---|
| 32 | 32 | | elected in 1997, and the three candidates receiving the highest |
|---|
| 33 | 33 | | number of votes in that year shall be elected for a term of three |
|---|
| 34 | 34 | | years.] In [the election of Directors held in 2000 and in] every |
|---|
| 35 | 35 | | [subsequent] election at which three Directors are elected, the |
|---|
| 36 | 36 | | three candidates receiving the highest number of votes shall be |
|---|
| 37 | 37 | | elected for a term of four years. In [the election of Directors |
|---|
| 38 | 38 | | held in 1998 and in] every [subsequent] election at which two |
|---|
| 39 | 39 | | Directors are elected, the two candidates receiving the highest |
|---|
| 40 | 40 | | number of votes shall be elected for a term of four years. |

| 41 | 41 | | SECTION 2. A member of the board of directors of the |
|---|
| 42 | 42 | | Benbrook Water Authority who is serving on the day before the |
|---|
| 43 | 43 | | effective date of this Act shall serve until the expiration of the |
|---|
| 44 | 44 | | director's term, as provided by Resolution No. 2012-4 adopted by |
|---|
| 45 | 45 | | the board of directors of the Benbrook Water Authority on February |
|---|
| 46 | 46 | | 7, 2012. |
|---|
| 47 | 47 | | SECTION 3. (a) The legal notice of the intention to |
|---|
| 48 | 48 | | introduce this Act, setting forth the general substance of this |
|---|
| 49 | 49 | | Act, has been published as provided by law, and the notice and a |
|---|
| 50 | 50 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 51 | 51 | | officials, or entities to which they are required to be furnished |
|---|
| 52 | 52 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 53 | 53 | | Government Code. |
|---|
| 54 | 54 | | (b) The governor, one of the required recipients, has |
|---|
| 55 | 55 | | submitted the notice and Act to the Texas Commission on |
|---|
| 56 | 56 | | Environmental Quality. |
|---|
| 57 | 57 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 58 | 58 | | its recommendations relating to this Act with the governor, the |
|---|
| 59 | 59 | | lieutenant governor, and the speaker of the house of |
|---|
| 60 | 60 | | representatives within the required time. |
|---|
| 61 | 61 | | (d) All requirements of the constitution and laws of this |
|---|
| 62 | 62 | | state and the rules and procedures of the legislature with respect |
|---|
| 63 | 63 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 64 | 64 | | and accomplished. |
|---|
| 65 | 65 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 66 | 66 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 67 | 67 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 68 | 68 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 69 | 69 | | Act takes effect September 1, 2013. |
