77 relating to the disposal of demolition waste from abandoned or
88 nuisance buildings by certain local governments.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subsection (b), Section 361.126, Health and
1111 Safety Code, is amended to read as follows:
1212 (b) The commission may issue a permit by rule to authorize
1313 the governing body of a county or municipality with a population of
1414 12,000 [10,000] or less to dispose of demolition waste from a
1515 building if the disposal occurs on land that:
1616 (1) the county or municipality owns or controls; and
1717 (2) would qualify for an arid exemption under
1818 commission rules.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2013.
