8 | 8 | nuisance buildings by certain local governments. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subsection (b), Section 361.126, Health and | |
11 | 11 | Safety Code, is amended to read as follows: | |
12 | 12 | (b) The commission may issue a permit by rule to authorize | |
13 | 13 | the governing body of a county or municipality with a population of | |
14 | 14 | 12,000 [10,000] or less to dispose of demolition waste from a | |
15 | 15 | building if the disposal occurs on land that: | |
16 | 16 | (1) the county or municipality owns or controls; and | |
17 | 17 | (2) would qualify for an arid exemption under | |
18 | 18 | commission rules. | |
19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
23 | 23 | Act takes effect September 1, 2013. |
