1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to use of telemedicine in certain trauma facilities.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter E, Chapter 773, Health and Safety
1515 Code, is amended by adding Section 773.1151 to read as follows:
1616 Sec. 773.1151. USE OF TELEMEDICINE BY CERTAIN TRAUMA
1717 FACILITIES. (a) In this section, "telemedicine" means a health
1818 care service that is initiated by a physician, advanced practice
1919 nurse, or physician assistant and that requires the use of advanced
2020 telecommunications technology, other than telephone or facsimile
2121 technology, including:
2222 (1) compressed digital interactive video, audio, or
2323 data transmission;
2424 (2) clinical data transmission using computer imaging
2525 by way of still-image capture and store and forward; and
2626 (3) other technology that facilitates access to health
2727 care services or medical specialty expertise.
2828 (b) A health care facility located in a county with a
2929 population of less than 50,000 may use telemedicine to satisfy a
3030 level IV trauma facility designation requirement relating to
3131 physicians if an on-call physician who has special competence in
3232 the care of critically injured patients uses telemedicine to
3333 provide patient assessment, diagnosis, consultation, or treatment
3434 or to transfer medical data to a physician, advanced practice
3535 nurse, or physician assistant located at the facility.
3636 (c) Department rules may not, as part of the requirements
3737 for designation of the facility as a level IV trauma facility,
3838 require the physical presence or physical availability of a
3939 physician who has special competence in the care of critically
4040 injured patients and may not prohibit the use of telemedicine that
4141 meets the requirements of Subsection (b).
4242 SECTION 2. The executive commissioner of the Health and
4343 Human Services Commission shall adopt rules to implement Section
4444 773.1151, Health and Safety Code, as added by this Act, not later
4545 than December 1, 2013.
4646 SECTION 3. Notwithstanding Section 773.1151, Health and
4747 Safety Code, as added by this Act, a health care facility located in
4848 a county with a population of less than 50,000 may use telemedicine
4949 to satisfy a level IV trauma facility designation requirement only
5050 on or after January 1, 2014.
5151 SECTION 4. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2013.
