11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 2054.375, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 2054.375. DEFINITIONS [DEFINITION]. In this |
---|
15 | 15 | | subchapter: |
---|
16 | 16 | | (1) "Governmental entity" means a state agency or |
---|
17 | 17 | | local government. |
---|
18 | 18 | | (2) "Statewide[, "statewide] technology center" means |
---|
19 | 19 | | a statewide technology center established or operated under this |
---|
20 | 20 | | subchapter. |
---|
21 | 21 | | SECTION 2. Section 2054.376(a), Government Code, is amended |
---|
22 | 22 | | to read as follows: |
---|
23 | 23 | | (a) This subchapter applies to all information resources |
---|
24 | 24 | | technologies, other than telecommunications service [services], |
---|
25 | 25 | | advanced communications services, or information service, as those |
---|
26 | 26 | | terms are defined by 47 U.S.C. Section 153, that are: |
---|
27 | 27 | | (1) obtained by a state agency using state money; [or] |
---|
28 | 28 | | (2) used by a state agency; or |
---|
29 | 29 | | (3) used by a participating local government. |
---|
30 | 30 | | SECTION 3. Subchapter L, Chapter 2054, Government Code, is |
---|
31 | 31 | | amended by adding Section 2054.3771 to read as follows: |
---|
32 | 32 | | Sec. 2054.3771. LOCAL GOVERNMENTS. The department may |
---|
33 | 33 | | establish or expand a statewide technology center to include |
---|
34 | 34 | | participation by a local government. The executive director and |
---|
35 | 35 | | the department have all the powers necessary or appropriate, |
---|
36 | 36 | | consistent with this chapter, to accomplish that purpose. |
---|
37 | 37 | | SECTION 4. Section 2054.378(a), Government Code, is amended |
---|
38 | 38 | | to read as follows: |
---|
39 | 39 | | (a) The department may operate statewide technology centers |
---|
40 | 40 | | to provide two or more governmental entities [state agencies], on a |
---|
41 | 41 | | cost-sharing basis, services relating to: |
---|
42 | 42 | | (1) information resources and information resources |
---|
43 | 43 | | technology; and |
---|
44 | 44 | | (2) the deployment, [and] development, and |
---|
45 | 45 | | maintenance of software [statewide] applications. |
---|
46 | 46 | | SECTION 5. Section 2054.380(a), Government Code, is amended |
---|
47 | 47 | | to read as follows: |
---|
48 | 48 | | (a) The department shall set and charge a fee to each |
---|
49 | 49 | | governmental entity [state agency] that receives a service from a |
---|
50 | 50 | | statewide technology center in an amount sufficient to cover the |
---|
51 | 51 | | direct and indirect cost of providing the service. |
---|
52 | 52 | | SECTION 6. Subchapter L, Chapter 2054, Government Code, is |
---|
53 | 53 | | amended by adding Section 2054.3851 to read as follows: |
---|
54 | 54 | | Sec. 2054.3851. LOCAL GOVERNMENT PARTICIPATION AND |
---|
55 | 55 | | SELECTION. (a) A local government may submit a request to the |
---|
56 | 56 | | department to receive services or operations through a statewide |
---|
57 | 57 | | technology center. The local government shall identify its |
---|
58 | 58 | | particular requirements, operations costs, and requested service |
---|
59 | 59 | | levels. |
---|
60 | 60 | | (b) On receipt of the request, the department shall conduct |
---|
61 | 61 | | a cost and requirements analysis for the local government. |
---|
62 | 62 | | (c) If the department selects the local government for |
---|
63 | 63 | | participation in a statewide technology center, the department |
---|
64 | 64 | | shall provide notice to the local government that includes: |
---|
65 | 65 | | (1) the scope of the services to be provided to the |
---|
66 | 66 | | local government; |
---|
67 | 67 | | (2) a schedule of anticipated costs for the local |
---|
68 | 68 | | government; and |
---|
69 | 69 | | (3) the implementation schedule for the local |
---|
70 | 70 | | government. |
---|
71 | 71 | | (d) If selected to participate in a statewide technology |
---|
72 | 72 | | center, a local government may contract with the department to |
---|
73 | 73 | | receive the identified services and have the identified operations |
---|
74 | 74 | | performed through the statewide technology center. |
---|
75 | 75 | | (e) Two or more local governments that are parties to an |
---|
76 | 76 | | interlocal agreement, acting through the entity designated by the |
---|
77 | 77 | | parties to supervise performance of the interlocal agreement under |
---|
78 | 78 | | Section 791.013, may apply to the department and participate in a |
---|
79 | 79 | | statewide technology center. |
---|
80 | 80 | | SECTION 7. Section 2054.387, Government Code, is amended to |
---|
81 | 81 | | read as follows: |
---|
82 | 82 | | Sec. 2054.387. INTERAGENCY CONTRACT; COMPLIANCE WITH |
---|
83 | 83 | | SERVICE LEVELS. The department shall ensure compliance with |
---|
84 | 84 | | service levels agreed to in an interagency contract or |
---|
85 | 85 | | intergovernmental contract, as appropriate, executed under this |
---|
86 | 86 | | subchapter. |
---|
87 | 87 | | SECTION 8. This Act takes effect immediately if it receives |
---|
88 | 88 | | a vote of two-thirds of all the members elected to each house, as |
---|
89 | 89 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
90 | 90 | | Act does not receive the vote necessary for immediate effect, this |
---|
91 | 91 | | Act takes effect September 1, 2013. |
