| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Subchapter B, Chapter 552, Government Code, is |
|---|
| 15 | 15 | | amended by adding Section 552.0216 to read as follows: |
|---|
| 16 | 16 | | Sec. 552.0216. RIGHT OF ACCESS TO CONFIDENTIAL INFORMATION |
|---|
| 17 | 17 | | AFTER 75 YEARS. (a) Information that is designated as |
|---|
| 18 | 18 | | confidential under law is public information and is available to |
|---|
| 19 | 19 | | the public: |
|---|
| 20 | 20 | | (1) on or after the 75th anniversary of the date the |
|---|
| 21 | 21 | | information was originally created or received by the applicable |
|---|
| 22 | 22 | | governmental body; or |
|---|
| 23 | 23 | | (2) after the expiration of a specified period for |
|---|
| 24 | 24 | | maintaining the confidentiality of the information in accordance |
|---|
| 25 | 25 | | with applicable law. |
|---|
| 26 | 26 | | (b) This section does not apply to: |
|---|
| 27 | 27 | | (1) information withheld under Section 442.007; |
|---|
| 28 | 28 | | (2) information covered by Section 552.147; or |
|---|
| 29 | 29 | | (3) information covered by Section 191.004, Natural |
|---|
| 30 | 30 | | Resources Code. |
|---|
| 31 | 31 | | (c) This section does not limit the authority of a |
|---|
| 32 | 32 | | governmental body to establish retention periods for records under |
|---|
| 33 | 33 | | applicable law. |
|---|
| 34 | 34 | | SECTION 2. This Act takes effect September 1, 2013. |
