| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 29.005, Education Code, is amended by | |
| 14 | 14 | adding Subsection (g) to read as follows: | |
| 15 | 15 | (g) The committee may determine that a behavior improvement | |
| 16 | 16 | plan or a behavioral intervention plan is appropriate for a student | |
| 17 | 17 | for whom the committee has developed an individualized education | |
| 18 | 18 | program. If the committee makes that determination, the behavior | |
| 19 | 19 | improvement plan or the behavioral intervention plan shall be | |
| 20 | 20 | included as part of the student's individualized education program | |
| 21 | 21 | and provided to each teacher with responsibility for educating the | |
| 22 | 22 | student. | |
| 23 | 23 | SECTION 2. This Act applies beginning with the 2013-2014 | |
| 24 | 24 | school year. | |
| 25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
| 26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
| 27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
| 28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
| 29 | 29 | Act takes effect September 1, 2013. |
