| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 253.001, Local Government Code, is |
|---|
| 13 | 13 | | amended by adding Subsections (m), (n), and (o) to read as follows: |
|---|
| 14 | 14 | | (m) Subsection (b) does not apply to the sale of a public |
|---|
| 15 | 15 | | square or park if: |
|---|
| 16 | 16 | | (1) the land was part of the site of a world exposition |
|---|
| 17 | 17 | | recognized by the Bureau International des Expositions; and |
|---|
| 18 | 18 | | (2) the remainder of the world exposition site |
|---|
| 19 | 19 | | includes dedicated public squares or parks that have a total area of |
|---|
| 20 | 20 | | 18 acres or more. |
|---|
| 21 | 21 | | (n) The area dedicated under Subsection (m)(2) may include |
|---|
| 22 | 22 | | an area for which the municipality commits to demolishing any |
|---|
| 23 | 23 | | non-park improvements within 48 months after the date of the |
|---|
| 24 | 24 | | dedication. |
|---|
| 25 | 25 | | (o) A petition for judicial review of a sale under |
|---|
| 26 | 26 | | Subsection (m) must be filed on or before the 60th day after the |
|---|
| 27 | 27 | | date the ordinance or resolution authorizing the sale is adopted. A |
|---|
| 28 | 28 | | petition filed after that date is barred. |
|---|
| 29 | 29 | | SECTION 2. Chapter 253, Local Government Code, is amended |
|---|
| 30 | 30 | | by adding Section 253.0011 to read as follows: |
|---|
| 31 | 31 | | Sec. 253.0011. SALE OR LEASE OF LAND USED FOR WORLD |
|---|
| 32 | 32 | | EXPOSITION RESTRICTED. If a municipality sells or leases a public |
|---|
| 33 | 33 | | square or park as authorized by Section 253.001(m), the aggregate |
|---|
| 34 | 34 | | square footage of hotel improvements to be constructed on any |
|---|
| 35 | 35 | | property sold or leased by the municipality that was part of the |
|---|
| 36 | 36 | | site of a world exposition recognized by the Bureau International |
|---|
| 37 | 37 | | des Expositions may not exceed 20 percent of the aggregate square |
|---|
| 38 | 38 | | footage of any improvements other than a convention center that: |
|---|
| 39 | 39 | | (1) are located on property sold or leased by the |
|---|
| 40 | 40 | | municipality on that site; and |
|---|
| 41 | 41 | | (2) are constructed after June 1, 2013. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect September 1, 2013. |
