77 relating to allowing the attorney general to obtain an injunction
88 against a municipality or county that adopts prohibited regulations
99 regarding firearms, ammunition, or firearm supplies.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 229.001, Local Government Code, is
1212 amended by adding Subsection (f) to read as follows:
1313 (f) The attorney general may bring an action in the name of
1414 the state to obtain a temporary or permanent injunction against a
1515 municipality adopting a regulation in violation of this section.
1616 SECTION 2. Section 236.002, Local Government Code, is
1717 amended to read as follows:
1818 Sec. 236.002. FIREARMS; SPORT SHOOTING RANGE.
1919 (a) Notwithstanding any other law, including Chapter 251,
2020 Agriculture Code, a county may not adopt regulations relating to:
2121 (1) the transfer, private ownership, keeping,
2222 transportation, licensing, or registration of firearms,
2323 ammunition, or firearm supplies; or
2424 (2) the discharge of a firearm at a sport shooting
2525 range.
2626 (b) The attorney general may bring an action in the name of
2727 the state to obtain a temporary or permanent injunction against a
2828 county adopting a regulation, other than a regulation under Section
2929 236.003, in violation of this section.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2013.
