99 SENATE JOINT RESOLUTION
1010 proposing a constitutional amendment requiring the reduction of
1111 amounts paid by Texans to provide health care to the uninsured if
1212 Medicaid eligibility is expanded in accordance with the federal
1313 Patient Protection and Affordable Care Act; requiring hospital
1414 district and county tax rate reductions.
1515 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Article III, Texas Constitution, is amended by
1717 adding Section 51-b to read as follows:
1818 Sec. 51-b. If this state expands eligibility for medical
1919 assistance in accordance with and provides medical assistance using
2020 federal matching funds made available under the Patient Protection
2121 and Affordable Care Act (Pub. L. No. 111-148) as amended by the
2222 Health Care and Education Reconciliation Act of 2010 (Pub. L. No.
2323 111-152) to provide that assistance, the legislature shall:
2424 (1) by law prescribe appropriate rate reductions for
2525 taxes imposed by hospital districts and counties in this state that
2626 reflect the reduction of health care costs of those districts and
2727 counties resulting from the receipt of additional federal funds for
2828 providing that assistance; and
2929 (2) reduce the amount of money appropriated for
3030 providing uncompensated care to residents of this state to reflect
3131 the reduced need for that care.
3232 SECTION 2. This proposed constitutional amendment shall be
3333 submitted to the voters at an election to be held November 5, 2013.
3434 The ballot shall be printed to provide for voting for or against the
3535 proposition: "The constitutional amendment requiring the
3636 reduction of amounts paid by Texans to provide health care to the
3737 uninsured if Medicaid eligibility is expanded in accordance with
3838 the federal Patient Protection and Affordable Care Act; requiring
3939 hospital district and county tax rate reductions."
