| 12 | 12 | | Medicaid eligibility is expanded in accordance with the federal |

| 13 | 13 | | Patient Protection and Affordable Care Act; requiring hospital |

| 15 | 15 | | BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 16 | 16 | | SECTION 1. Article III, Texas Constitution, is amended by |
|---|
| 17 | 17 | | adding Section 51-b to read as follows: |
|---|
| 18 | 18 | | Sec. 51-b. If this state expands eligibility for medical |
|---|
| 19 | 19 | | assistance in accordance with and provides medical assistance using |
|---|
| 20 | 20 | | federal matching funds made available under the Patient Protection |
|---|
| 21 | 21 | | and Affordable Care Act (Pub. L. No. 111-148) as amended by the |
|---|
| 22 | 22 | | Health Care and Education Reconciliation Act of 2010 (Pub. L. No. |
|---|
| 23 | 23 | | 111-152) to provide that assistance, the legislature shall: |
|---|
| 24 | 24 | | (1) by law prescribe appropriate rate reductions for |
|---|
| 25 | 25 | | taxes imposed by hospital districts and counties in this state that |
|---|
| 26 | 26 | | reflect the reduction of health care costs of those districts and |
|---|
| 27 | 27 | | counties resulting from the receipt of additional federal funds for |
|---|
| 28 | 28 | | providing that assistance; and |
|---|
| 29 | 29 | | (2) reduce the amount of money appropriated for |
|---|
| 30 | 30 | | providing uncompensated care to residents of this state to reflect |
|---|
| 31 | 31 | | the reduced need for that care. |
|---|
| 32 | 32 | | SECTION 2. This proposed constitutional amendment shall be |
|---|
| 33 | 33 | | submitted to the voters at an election to be held November 5, 2013. |
|---|
| 34 | 34 | | The ballot shall be printed to provide for voting for or against the |
|---|
| 35 | 35 | | proposition: "The constitutional amendment requiring the |
|---|
| 36 | 36 | | reduction of amounts paid by Texans to provide health care to the |
|---|
| 37 | 37 | | uninsured if Medicaid eligibility is expanded in accordance with |
|---|
| 38 | 38 | | the federal Patient Protection and Affordable Care Act; requiring |
|---|
| 39 | 39 | | hospital district and county tax rate reductions." |
