7	7	relating to the composition of districts for the election of
8	8	members of the Texas Legislature and the United States House of
9	9	Representatives from Texas.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. The interim redistricting plan used to elect
12	12	members of the Texas House of Representatives in 2012 ordered by the
13	13	United States District Court for the Western District of Texas on
14	14	February 28, 2012, in the case of Perez, et al. v. Perry, et al. (No.
15	15	SA-11-CV-360), and identified as PLANH309 on the redistricting
16	16	computer system operated by the Texas Legislative Council, is
17	17	hereby ratified and adopted as the permanent plan for districts
18	18	used to elect members of the Texas House of Representatives.
19	19	SECTION 2. The interim redistricting plan used to elect
20	20	members of the Texas Senate in 2012 ordered by the United States
21	21	District Court for the Western District of Texas on February 28,
22	22	2012, in the case of Davis, et al. v. Perry, et al. (No.
23	23	SA-11-CV-788), and identified as PLANS172 on the redistricting
24	24	computer system operated by the Texas Legislative Council, is
25	25	hereby ratified and adopted as the permanent plan for districts
26	26	used to elect members of the Texas Senate.
27	27	SECTION 3. The interim redistricting plan used to elect
28	28	members of the United States House of Representatives from the
29	29	State of Texas in 2012 ordered by the United States District Court
30	30	for the Western District of Texas on February 28, 2012, in the case
31	31	of Perez, et al. v. Perry, et al. (No. SA-11-CV-360), and identified
32	32	as PLANC235 on the redistricting computer system operated by the
33	33	Texas Legislative Council, is hereby ratified and adopted as the
34	34	permanent plan for districts used to elect members of the United
35	35	States House of Representatives from the State of Texas.
36	36	SECTION 4. In making this enactment the legislature finds
37	37	that:
38	38	(1) the United States District Court for the Western
39	39	District of Texas properly applied the decision of the United
40	40	States Supreme Court on January 20, 2012, in Perry, et al. v. Perez,
41	41	et al., 565 U.S. ____ (2012) (per curiam), in the creation of the
42	42	district court's interim plans for use in the 2012 elections;
43	43	(2) the district court's interim plans comply with all
44	44	federal and state constitutional provisions or laws applicable to
45	45	redistricting plans, including the federal Voting Rights Act; and
46	46	(3) the adoption of the district court's interim plans
47	47	as permanent plans by the Texas Legislature will:
48	48	(A) diminish the expense of further time and
49	49	money by all parties in Texas' ongoing redistricting litigation;
50	50	(B) avoid disruption of the upcoming election
51	51	cycle; and
52	52	(C) provide certainty and continuity to the
53	53	citizens of Texas regarding the districts used to elect members of
54	54	the legislature and the United States House of Representatives from
55	55	Texas.
56	56	SECTION 5. The following laws are repealed:
57	57	(1) Chapter 1271 (H.B. 150), Acts of the 82nd
58	58	Legislature, Regular Session, 2011 (Article 195a-12, Vernon's
59	59	Texas Civil Statutes);
60	60	(2) Chapter 1315 (S.B. 31), Acts of the 82nd
61	61	Legislature, Regular Session, 2011 (Article 193e, Vernon's Texas
62	62	Civil Statutes); and
63	63	(3) Chapter 1 (S.B. 4), Acts of the 82nd Legislature,
64	64	1st Called Session, 2011 (Article 197j, Vernon's Texas Civil
65	65	Statutes).
66	66	SECTION 6. This Act takes effect immediately if it receives
67	67	a vote of two-thirds of all the members elected to each house, as
68	68	provided by Section 39, Article III, Texas Constitution. If this
69	69	Act does not receive the vote necessary for immediate effect, this
70	70	Act takes effect on the 91st day after the last day of the
71	71	legislative session.
