88 relating to authorizing the issuance of revenue bonds to fund
99 capital projects at public institutions of higher education; making
1010 an appropriation.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 55, Education Code, is
1313 amended by adding Sections 55.1781, 55.1782, 55.1783, 55.1784,
1414 55.1785, 55.1786, 55.1787, 55.1788, 55.1789, 55.17891, and
1515 55.17892 to read as follows:
1616 Sec. 55.1781. THE TEXAS A&M UNIVERSITY SYSTEM; ADDITIONAL
1717 BONDS. (a) In addition to the other authority granted by this
1818 subchapter, the board of regents of The Texas A&M University System
1919 may acquire, purchase, construct, improve, renovate, enlarge, or
2020 equip property and facilities, including roads and related
2121 infrastructure, for projects to be financed through the issuance of
2222 bonds in accordance with this subchapter and in accordance with a
2323 systemwide revenue financing program adopted by the board for the
2424 following institutions, not to exceed the following aggregate
2525 principal amounts for the projects specified, as follows:
2626 (1) Texas A&M University--Commerce, $40 million for a
2727 library and technology center;
2828 (2) Texas A&M University--Corpus Christi, $60 million
2929 for a life sciences research building;
3030 (3) Texas A&M University--Kingsville, $33.6 million
3131 for music building expansion and renovation of Jones Auditorium;
3232 (4) Texas A&M University--Texarkana, $36.8 million
3333 for an academic and laboratory learning center;
3434 (5) West Texas A&M University, $12 million for the
3535 Amarillo Center;
3636 (6) The Texas A&M University System Health Science
3737 Center:
3838 (A) $7.2 million for facilities in Round Rock,
3939 Texas;
4040 (B) $36 million for a research building in
4141 Temple, Texas; and
4242 (C) $64 million for an education center and
4343 research building in Dallas, Texas;
4444 (7) Texas A&M International University, $41.6 million
4545 for library renovation, additional instructional spaces, and a
4646 support services building;
4747 (8) Prairie View A&M University, $12.8 million for
4848 critical deferred maintenance;
4949 (9) Tarleton State University:
5050 (A) $52 million for the Gates Agriculture and
5151 Business Building; and
5252 (B) $12 million for the Midlothian Higher
5353 Education Center;
5454 (10) Texas A&M University, $64 million for a
5555 biocontainment research facility;
5656 (11) Texas A&M University at Galveston, $36.8 million
5757 for an academic building;
5858 (12) Texas A&M University--Central Texas, $50 million
5959 for a science, health science, and wellness building; and
6060 (13) Texas A&M University--San Antonio, $70 million
6161 for a science and technology building.
6262 (b) The board may pledge irrevocably to the payment of bonds
6363 authorized by this section all or any part of the revenue funds of
6464 an institution, branch, or entity of The Texas A&M University
6565 System, including student tuition charges. The amount of a pledge
6666 made under this subsection may not be reduced or abrogated while the
6767 bonds for which the pledge is made, or bonds issued to refund those
6868 bonds, are outstanding.
6969 (c) If sufficient funds are not available to the board to
7070 meet its obligations under this section, the board may transfer
7171 funds among institutions, branches, and entities of The Texas A&M
7272 University System to ensure the most equitable and efficient
7373 allocation of available resources for each institution, branch, or
7474 entity to carry out its duties and purposes.
7575 Sec. 55.1782. THE UNIVERSITY OF TEXAS SYSTEM; ADDITIONAL
7676 BONDS. (a) In addition to the other authority granted by this
7777 subchapter, the board of regents of The University of Texas System
7878 may acquire, purchase, construct, improve, renovate, enlarge, or
7979 equip property and facilities, including roads and related
8080 infrastructure, for projects to be financed through the issuance of
8181 bonds in accordance with this subchapter and in accordance with a
8282 systemwide revenue financing program adopted by the board for the
8383 following institutions, not to exceed the following aggregate
8484 principal amounts for the projects specified, as follows:
8585 (1) The University of Texas at Austin, $95 million for
8686 an engineering education and research center;
8787 (2) The University of Texas at Brownsville or its
8888 successor university, $100 million for a new campus in Brownsville;
8989 (3) The University of Texas--Pan American, $78.4
9090 million for Science Building II;
9191 (4) The University of Texas Southwestern Medical
9292 Center at Dallas, $60 million for north campus Phase VI vivarium and
9393 research facilities;
9494 (5) The University of Texas Health Science Center at
9595 San Antonio, $11.2 million for a South Texas diabetes institute and
9696 for an enhanced performance laboratory of the Barshop Institute for
9797 Longevity and Aging Studies;
9898 (6) The University of Texas M. D. Anderson Cancer
9999 Center, $50 million for a personalized cancer care building;
100100 (7) The University of Texas Medical Branch at
101101 Galveston, $40 million for a health education center;
102102 (8) The University of Texas at Arlington, $64.3
103103 million for renovation of and addition to a life science building;
104104 (9) The University of Texas at Dallas, $76 million for
105105 an engineering building;
106106 (10) The University of Texas at El Paso, $88 million
107107 for an interdisciplinary research facility;
108108 (11) The University of Texas at San Antonio, $74.2
109109 million for an experimental science instructional building;
110110 (12) The University of Texas at Tyler, $38.8 million
111111 for a STEM and business complex and renovation of the business
112112 building;
113113 (13) The University of Texas Health Science Center at
114114 Houston, $100 million for the renovation and modernization of
115115 educational and research facilities;
116116 (14) The University of Texas Health Science Center at
117117 Tyler, $4,804,000 for the Riter Center Primary Care Training Center
118118 renovation; and
119119 (15) The University of Texas of the Permian Basin, $48
120120 million for an engineering building.
121121 (b) The board may pledge irrevocably to the payment of bonds
122122 authorized by this section all or any part of the revenue funds of
123123 an institution, branch, or entity of The University of Texas
124124 System, including student tuition charges. The amount of a pledge
125125 made under this subsection may not be reduced or abrogated while the
126126 bonds for which the pledge is made, or bonds issued to refund those
127127 bonds, are outstanding.
128128 (c) If sufficient funds are not available to the board to
129129 meet its obligations under this section, the board may transfer
130130 funds among institutions, branches, and entities of The University
131131 of Texas System to ensure the most equitable and efficient
132132 allocation of available resources for each institution, branch, or
133133 entity to carry out its duties and purposes.
134134 Sec. 55.1783. UNIVERSITY OF HOUSTON SYSTEM; ADDITIONAL
135135 BONDS. (a) In addition to the other authority granted by this
136136 subchapter, the board of regents of the University of Houston
137137 System may acquire, purchase, construct, improve, renovate,
138138 enlarge, or equip property and facilities, including roads and
139139 related infrastructure, for projects to be financed through the
140140 issuance of bonds in accordance with this subchapter and in
141141 accordance with a systemwide revenue financing program adopted by
142142 the board for the following institutions, not to exceed the
143143 following aggregate principal amounts for the projects specified,
144144 as follows:
145145 (1) the University of Houston, $70 million for a
146146 pharmacy and biomedical sciences building;
147147 (2) the University of Houston--Clear Lake, $67.2
148148 million for a science and academic support building;
149149 (3) the University of Houston--Downtown, $37.2
150150 million for a science and technology building; and
151151 (4) the University of Houston--Victoria, $78,356,800
152152 for campus expansion.
153153 (b) The board may pledge irrevocably to the payment of bonds
154154 authorized by this section all or any part of the revenue funds of
155155 an institution, branch, or entity of the University of Houston
156156 System, including student tuition charges. The amount of a pledge
157157 made under this subsection may not be reduced or abrogated while the
158158 bonds for which the pledge is made, or bonds issued to refund those
159159 bonds, are outstanding.
160160 (c) If sufficient funds are not available to the board to
161161 meet its obligations under this section, the board may transfer
162162 funds among institutions, branches, and entities of the University
163163 of Houston System to ensure the most equitable and efficient
164164 allocation of available resources for each institution, branch, or
165165 entity to carry out its duties and purposes.
166166 Sec. 55.1784. TEXAS STATE UNIVERSITY SYSTEM; ADDITIONAL
167167 BONDS. (a) In addition to the other authority granted by this
168168 subchapter, the board of regents of the Texas State University
169169 System may acquire, purchase, construct, improve, renovate,
170170 enlarge, or equip property and facilities, including roads and
171171 related infrastructure, for projects to be financed through the
172172 issuance of bonds in accordance with this subchapter and in
173173 accordance with a systemwide revenue financing program adopted by
174174 the board for the following institutions, not to exceed the
175175 following aggregate principal amounts for the projects specified,
176176 as follows:
177177 (1) Lamar University, $32 million for a science
178178 building;
179179 (2) Lamar State College--Orange, $14,222,400 for a
180180 multipurpose education building;
181181 (3) Lamar State College--Port Arthur, $2,180,000 for
182182 an addition to the allied health building;
183183 (4) Lamar Institute of Technology, $12 million for
184184 renovation and replacement of the technical arts buildings;
185185 (5) Texas State University--San Marcos:
186186 (A) $44.8 million for a medical education and
187187 research building in Round Rock, Texas; and
188188 (B) $73,265,729 for an engineering and science
189189 building;
190190 (6) Sam Houston State University, $31,720,000 for a
191191 biology, nursing, and allied health building; and
192192 (7) Sul Ross State University, $3.4 million for
193193 renovation and modernization of educational and related facilities
194194 and infrastructure.
195195 (b) The board may pledge irrevocably to the payment of bonds
196196 authorized by this section all or any part of the revenue funds of
197197 an institution, branch, or entity of the Texas State University
198198 System, including student tuition charges. The amount of a pledge
199199 made under this subsection may not be reduced or abrogated while the
200200 bonds for which the pledge is made, or bonds issued to refund those
201201 bonds, are outstanding.
202202 (c) If sufficient funds are not available to the board to
203203 meet its obligations under this section, the board may transfer
204204 funds among institutions, branches, and entities of the Texas State
205205 University System to ensure the most equitable and efficient
206206 allocation of available resources for each institution, branch, or
207207 entity to carry out its duties and purposes.
208208 Sec. 55.1785. UNIVERSITY OF NORTH TEXAS SYSTEM; ADDITIONAL
209209 BONDS. (a) In addition to the other authority granted by this
210210 subchapter, the board of regents of the University of North Texas
211211 System may acquire, purchase, construct, improve, renovate,
212212 enlarge, or equip property and facilities, including roads and
213213 related infrastructure, for projects to be financed through the
214214 issuance of bonds in accordance with this subchapter and in
215215 accordance with a systemwide revenue financing program adopted by
216216 the board for the following institutions, not to exceed the
217217 following aggregate principal amounts for the projects specified,
218218 as follows:
219219 (1) the University of North Texas System, $56 million
220220 for college of law building renovations;
221221 (2) the University of North Texas, $73.6 million for a
222222 college of visual arts and design facility;
223223 (3) the University of North Texas at Dallas, $70
224224 million for a library and student success center; and
225225 (4) the University of North Texas Health Science
226226 Center at Fort Worth, $66,600,000 for an interdisciplinary research
227227 building.
228228 (b) The board may pledge irrevocably to the payment of bonds
229229 authorized by this section all or any part of the revenue funds of
230230 an institution, branch, or entity of the University of North Texas
231231 System, including student tuition charges. The amount of a pledge
232232 made under this subsection may not be reduced or abrogated while the
233233 bonds for which the pledge is made, or bonds issued to refund those
234234 bonds, are outstanding.
235235 (c) If sufficient funds are not available to the board to
236236 meet its obligations under this section, the board may transfer
237237 funds among institutions, branches, and entities of the University
238238 of North Texas System to ensure the most equitable and efficient
239239 allocation of available resources for each institution, branch, or
240240 entity to carry out its duties and purposes.
241241 Sec. 55.1786. TEXAS WOMAN'S UNIVERSITY. (a) In addition to
242242 the other authority granted by this subchapter, the board of
243243 regents of Texas Woman's University may acquire, purchase,
244244 construct, improve, renovate, enlarge, or equip property and
245245 facilities, including roads and related infrastructure, for a
246246 science and technology learning center, to be financed through the
247247 issuance of bonds in accordance with this subchapter, not to exceed
248248 the aggregate principal amount of $37,996,928.
249249 (b) The board may pledge irrevocably to the payment of bonds
250250 authorized by this section all or any part of the revenue funds of
251251 Texas Woman's University, including student tuition charges. The
252252 amount of a pledge made under this subsection may not be reduced or
253253 abrogated while the bonds for which the pledge is made, or bonds
254254 issued to refund those bonds, are outstanding.
255255 Sec. 55.1787. MIDWESTERN STATE UNIVERSITY; ADDITIONAL
256256 BONDS. (a) In addition to the other authority granted by this
257257 subchapter, the board of regents of Midwestern State University may
258258 acquire, purchase, construct, improve, renovate, enlarge, or equip
259259 property and facilities, including roads and related
260260 infrastructure, for library, College of Education, and information
261261 technology facilities at Midwestern State University, to be
262262 financed through the issuance of bonds in accordance with this
263263 subchapter, not to exceed the aggregate principal amount of
264264 $23,992,000.
265265 (b) The board may pledge irrevocably to the payment of bonds
266266 authorized by this section all or any part of the revenue funds of
267267 Midwestern State University, including student tuition charges.
268268 The amount of a pledge made under this subsection may not be reduced
269269 or abrogated while the bonds for which the pledge is made, or bonds
270270 issued to refund those bonds, are outstanding.
271271 Sec. 55.1788. STEPHEN F. AUSTIN STATE UNIVERSITY. (a) In
272272 addition to the other authority granted by this subchapter, the
273273 board of regents of Stephen F. Austin State University may acquire,
274274 purchase, construct, improve, renovate, enlarge, or equip property
275275 and facilities, including roads and related infrastructure, for a
276276 science, technology, engineering, and mathematics research
277277 building at Stephen F. Austin State University, to be financed
278278 through the issuance of bonds in accordance with this subchapter,
279279 not to exceed the aggregate principal amount of $40 million.
280280 (b) The board may pledge irrevocably to the payment of bonds
281281 authorized by this section all or any part of the revenue funds of
282282 Stephen F. Austin State University, including student tuition
283283 charges. The amount of a pledge made under this subsection may not
284284 be reduced or abrogated while the bonds for which the pledge is
285285 made, or bonds issued to refund those bonds, are outstanding.
286286 Sec. 55.1789. TEXAS TECH UNIVERSITY SYSTEM; ADDITIONAL
287287 BONDS. (a) In addition to the other authority granted by this
288288 subchapter, the board of regents of the Texas Tech University
289289 System may acquire, purchase, construct, improve, renovate,
290290 enlarge, or equip property and facilities, including roads and
291291 related infrastructure, for projects to be financed through the
292292 issuance of bonds in accordance with this subchapter and in
293293 accordance with a systemwide revenue financing program adopted by
294294 the board for the following institutions, not to exceed the
295295 following aggregate principal amounts for the projects specified,
296296 as follows:
297297 (1) Texas Tech University Health Sciences Center:
298298 (A) $36 million for Lubbock education, research,
299299 and technology facilities;
300300 (B) $79.2 million for the El Paso Medical Science
301301 Building II; and
302302 (C) $15,120,000 for the Permian Basin academic
303303 facility;
304304 (2) Texas Tech University, $70.2 million for a
305305 research building; and
306306 (3) Angelo State University, $14,896,000 for a health
307307 and human services building.
308308 (b) The board may pledge irrevocably to the payment of bonds
309309 authorized by this section all or any part of the revenue funds of
310310 an institution, branch, or entity of the Texas Tech University
311311 System, including student tuition charges. The amount of a pledge
312312 made under this subsection may not be reduced or abrogated while the
313313 bonds for which the pledge is made, or bonds issued to refund those
314314 bonds, are outstanding.
315315 (c) If sufficient funds are not available to the board to
316316 meet its obligations under this section, the board may transfer
317317 funds among institutions, branches, and entities of the Texas Tech
318318 University System to ensure the most equitable and efficient
319319 allocation of available resources for each institution, branch, or
320320 entity to carry out its duties and purposes.
321321 Sec. 55.17891. TEXAS SOUTHERN UNIVERSITY; ADDITIONAL
322322 BONDS. (a) In addition to the other authority granted by this
323323 subchapter, the board of regents of Texas Southern University may
324324 acquire, purchase, construct, improve, renovate, enlarge, or equip
325325 property and facilities, including roads and related
326326 infrastructure, for the Robert J. Terry Library at Texas Southern
327327 University, to be financed through the issuance of bonds in
328328 accordance with this subchapter, not to exceed the aggregate
329329 principal amount of $52,814,129.
330330 (b) The board may pledge irrevocably to the payment of bonds
331331 authorized by this section all or any part of the revenue funds of
332332 Texas Southern University, including student tuition charges. The
333333 amount of a pledge made under this subsection may not be reduced or
334334 abrogated while the bonds for which the pledge is made, or bonds
335335 issued to refund those bonds, are outstanding.
336336 Sec. 55.17892. TEXAS STATE TECHNICAL COLLEGE SYSTEM. (a) In
337337 addition to the other authority granted by this subchapter, the
338338 board of regents of the Texas State Technical College System may
339339 acquire, purchase, construct, improve, renovate, enlarge, or equip
340340 property and facilities, including roads and related
341341 infrastructure, for projects to be financed through the issuance of
342342 bonds in accordance with this subchapter for the following
343343 institutions, not to exceed the following aggregate principal
344344 amounts for the projects specified, as follows:
345345 (1) Texas State Technical College System, $35 million
346346 for the Ellis County Extension Center;
347347 (2) Texas State Technical College--Harlingen, $2.4
348348 million for Phase II of the Engineering Technology Center
349349 renovation;
350350 (3) Texas State Technical College--Marshall, $1.2
351351 million for renovation of aviation technology facilities; and
352352 (4) Texas State Technical College--Waco, $5 million
353353 for water system infrastructure replacement.
354354 (b) The board may pledge irrevocably to the payment of those
355355 bonds all or any part of the revenue funds of an institution,
356356 branch, or entity of the Texas State Technical College System,
357357 including student tuition charges. The amount of a pledge made
358358 under this subsection may not be reduced or abrogated while the
359359 bonds for which the pledge is made, or bonds issued to refund those
360360 bonds, are outstanding.
361361 (c) If sufficient funds are not available to the board to
362362 meet its obligations under this section, the board may transfer
363363 funds among institutions, branches, and entities of the Texas State
364364 Technical College System to ensure the most equitable and efficient
365365 allocation of available resources for each institution, branch, or
366366 entity to carry out its duties and purposes.
367367 SECTION 2. This Act does not affect any authority or
368368 restriction regarding the activities that a public institution of
369369 higher education may conduct in connection with a facility financed
370370 by bonds authorized by this Act.
371371 SECTION 3. (a) The amount of $175 million is appropriated
372372 out of the general revenue fund to the comptroller of public
373373 accounts for the state fiscal year ending August 31, 2015, for
374374 distribution to institutions of higher education and university
375375 systems for debt service on revenue bonds authorized by this Act.
376376 (b) The comptroller shall distribute a portion of the amount
377377 appropriated by Subsection (a) of this section to each institution
378378 of higher education or university system, as applicable, in
379379 accordance with calculations made by the Legislative Budget Board
380380 of each institution's or system's proportionate share of the amount
381381 appropriated based on the amount of revenue bonds authorized by
382382 this Act for each institution or system.
383383 (c) The Legislative Budget Board shall make the initial
384384 calculations under this section and notify the comptroller and the
385385 applicable institutions of higher education and university systems
386386 of the respective shares to be distributed under this section as
387387 soon as practicable. The Legislative Budget Board may make
388388 adjustments to those calculations and provide a final determination
389389 of those shares.
390390 SECTION 4. This Act takes effect on the 91st day after the
391391 last day of the legislative session.
