11	5		relating to the sale by package stores of containers of liquor with
12	6		a capacity of less than six fluid ounces.
13	7		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	8		SECTION 1. Section 101.46(a), Alcoholic Beverage Code, is
15	9		amended to read as follows:
16	10		(a) Except as provided by Subsections (b), (c), and (d) [of
17	11		this section], no person may import, sell, or possess with intent to
18	12		sell any liquor in a container with a capacity of less than 20
19	13		milliliters. A container of liquor offered for sale that has a
20	14		capacity of less than six fluid ounces must substantially conform
21	15		to the labeling requirements of the Bureau of Alcohol, Tobacco, and
22	16		Firearms for larger containers in which liquor is sold. Holders of
23	17		distiller's or rectifier's permits wishing to sell liquor bottled
24	18		in containers of less than six fluid ounces to wholesalers must sell
25	19		such containers of liquor to wholesalers in units of unbroken,
26	20		sealed cases. Wholesalers shall sell liquor bottled in containers
27	21		of less than six fluid ounces to package stores in units of
28	22		unbroken, sealed cases. [Containers of liquor with a capacity of
29	23		less than six fluid ounces offered for sale in a package store must
30	24		be sold in units of sealed packages featuring multiple bottles of
31	25		liquor.]
32	26		SECTION 2. This Act takes effect immediately if it receives
33	27		a vote of two-thirds of all the members elected to each house, as
34	28		provided by Section 39, Article III, Texas Constitution. If this
35	29		Act does not receive the vote necessary for immediate effect, this
36	30		Act takes effect September 1, 2015.
