104 AN ACT
115 relating to the sale by package stores of containers of liquor with
126 a capacity of less than six fluid ounces.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 101.46(a), Alcoholic Beverage Code, is
159 amended to read as follows:
1610 (a) Except as provided by Subsections (b), (c), and (d) [of
1711 this section], no person may import, sell, or possess with intent to
1812 sell any liquor in a container with a capacity of less than 20
1913 milliliters. A container of liquor offered for sale that has a
2014 capacity of less than six fluid ounces must substantially conform
2115 to the labeling requirements of the Bureau of Alcohol, Tobacco, and
2216 Firearms for larger containers in which liquor is sold. Holders of
2317 distiller's or rectifier's permits wishing to sell liquor bottled
2418 in containers of less than six fluid ounces to wholesalers must sell
2519 such containers of liquor to wholesalers in units of unbroken,
2620 sealed cases. Wholesalers shall sell liquor bottled in containers
2721 of less than six fluid ounces to package stores in units of
2822 unbroken, sealed cases. [Containers of liquor with a capacity of
2923 less than six fluid ounces offered for sale in a package store must
3024 be sold in units of sealed packages featuring multiple bottles of
3125 liquor.]
3226 SECTION 2. This Act takes effect immediately if it receives
3327 a vote of two-thirds of all the members elected to each house, as
3428 provided by Section 39, Article III, Texas Constitution. If this
3529 Act does not receive the vote necessary for immediate effect, this
3630 Act takes effect September 1, 2015.
