125 relating to the prosecution of the offense of interference with
136 public duties.
147 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
158 SECTION 1. Section 38.15, Penal Code, is amended by adding
169 Subsections (d-1) and (d-2) to read as follows:
1710 (d-1) Except as provided by Subsection (d-2), in a
1811 prosecution for an offense under Subsection (a)(1), there is a
1912 rebuttable presumption that the actor interferes with a peace
2013 officer if it is shown on the trial of the offense that the actor
2114 intentionally disseminated the home address, home telephone
2215 number, emergency contact information, or social security number of
2316 the officer or a family member of the officer or any other
2417 information that is specifically described by Section 552.117(a),
2518 Government Code.
2619 (d-2) The presumption in Subsection (d-1) does not apply to
2720 information disseminated by:
2821 (1) a radio or television station that holds a license
2922 issued by the Federal Communications Commission; or
3023 (2) a newspaper that is:
3124 (A) a free newspaper of general circulation or
3225 qualified to publish legal notices;
3326 (B) published at least once a week; and
3427 (C) available and of interest to the general
3528 public.
3629 SECTION 2. The change in law made by this Act applies only
3730 to an offense committed on or after the effective date of this Act.
3831 An offense committed before the effective date of this Act is
3932 governed by the law in effect on the date the offense was committed,
4033 and the former law is continued in effect for that purpose. For
4134 purposes of this section, an offense was committed before the
4235 effective date of this Act if any element of the offense occurred
4336 before that date.
4437 SECTION 3. This Act takes effect September 1, 2015.
