23	23	relating to the residence address of a person for purposes of a
24	24	response to a confirmation notice sent by the registrar.
25	25	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
26	26	SECTION 1. Section 15.052(b), Election Code, is amended to
27	27	read as follows:
28	28	(b) The official confirmation notice response form must:
29	29	(1) provide spaces for the voter to include all of the
30	30	information that a person must include in an application to
31	31	register to vote under Section 13.002; [and]
32	32	(2) describe the requirements of Section 15.054,
33	33	provide a space for the voter to indicate if the voter is exempt
34	34	from those requirements, and provide a space to indicate the reason
35	35	for an exemption, if any; and
36	36	(3) be postage prepaid and preaddressed for delivery
37	37	to the registrar.
38	38	SECTION 2. Section 15.053(a), Election Code, is amended to
39	39	read as follows:
40	40	(a) Not later than the 30th day after the date a
41	41	confirmation notice is mailed, the voter shall submit to the
42	42	registrar a written, signed response to the notice that confirms
43	43	the voter's current residence. The response must contain:
44	44	(1) all of the information that a person must include
45	45	in an application to register to vote under Section 13.002; and
46	46	(2) evidence that the voter's residence address is
47	47	established in compliance with Section 15.054 or an indication that
48	48	the voter is exempt from those requirements.
49	49	SECTION 3. Subchapter C, Chapter 15, Election Code, is
50	50	amended by adding Section 15.054 to read as follows:
51	51	Sec. 15.054. RESIDENCE FOR PURPOSES OF CONFIRMATION NOTICE
52	52	RESPONSE. (a) For purposes of Section 15.053, a person's residence
53	53	is established at the first residence address, beginning with
54	54	Subdivision (1) and continuing through Subdivision (6), in the
55	55	following list that is applicable to the person:
56	56	(1) the address stated on a driver's license issued to
57	57	the person by the Department of Public Safety that has not expired
58	58	or, if the person has notified the department of a change of address
59	59	under Section 521.054, Transportation Code, the new address
60	60	contained in the notification;
61	61	(2) the address stated on a personal identification
62	62	card issued to the person by the Department of Public Safety that
63	63	has not expired or, if the person has notified the department of a
64	64	change of address under Section 521.054, Transportation Code, the
65	65	new address contained in the notification;
66	66	(3) the address stated on a license to carry a
67	67	concealed handgun issued to the person by the Department of Public
68	68	Safety that has not expired or, if the person has notified the
69	69	department of a change of address under Section 411.181, Government
70	70	Code, the new address contained in the notification;
71	71	(4) an address corresponding to a residence at which
72	72	the person receives mail;
73	73	(5) the address the person claims as a homestead in
74	74	this state; or
75	75	(6) the registration address of a vehicle the person
76	76	owns.
77	77	(b) A person whose residence in this state has no address
78	78	may establish residence under this section by executing an
79	79	affidavit stating that the person's residence in this state has no
80	80	address, providing a concise description of the location of the
81	81	person's residence, and delivering the affidavit to the registrar
82	82	with the person's response to the confirmation notice.
83	83	(c) The address described by Subsection (a)(4) may not be a
84	84	commercial post office box or similar location that does not
85	85	correspond to a residence.
86	86	(d) This section does not apply to:
87	87	(1) a person who is a member of the armed forces of the
88	88	United States or the spouse or a dependent of a member;
89	89	(2) a person enrolled as a full-time student at an
90	90	institution of higher education;
91	91	(3) a person whose address is confidential under
92	92	Subchapter C, Chapter 56, Code of Criminal Procedure;
93	93	(4) a federal judge, state judge, or spouse of a
94	94	federal or state judge whose driver's license includes the street
95	95	address of a courthouse under Section 521.121, Transportation Code;
96	96	or
97	97	(5) a peace officer whose driver's license omits the
98	98	officer's actual residence address under Section 521.1211,
99	99	Transportation Code.
100	100	(e) Subsection (a)(1) does not apply to a person who holds a
101	101	commercial driver's license under Subchapter C, Chapter 522,
102	102	Transportation Code.
103	103	(f) The secretary of state shall adopt rules as necessary to
104	104	implement this section.
105	105	SECTION 4. This Act takes effect September 1, 2015.
