| 12 | 6 | | damaged as a result of a pursuit involving a federal law enforcement |

| 14 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 9 | | SECTION 1. Section 683.015(f), Transportation Code, is |
|---|
| 16 | 10 | | amended to read as follows: |
|---|
| 17 | 11 | | (f) A law enforcement agency or an attorney representing the |
|---|
| 18 | 12 | | state may use funds transferred under Subsection (d) to compensate |
|---|
| 19 | 13 | | property owners whose property was damaged as a result of a pursuit |
|---|
| 20 | 14 | | involving a law enforcement agency or a federal law enforcement |
|---|
| 21 | 15 | | agency, regardless of whether the agency would be liable under |
|---|
| 22 | 16 | | Chapter 101, Civil Practice and Remedies Code. |
|---|
| 23 | 17 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 18 | | to property damage occurring on or after the effective date of this |
|---|
| 25 | 19 | | Act. Property damage occurring before the effective date of this |
|---|
| 26 | 20 | | Act is governed by the law in effect at the time the damage |
|---|
| 27 | 21 | | occurred, and the former law is continued in effect for that |
|---|
| 28 | 22 | | purpose. |
|---|
| 29 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 27 | | Act takes effect September 1, 2015. |
