104 AN ACT
115 relating to the compensation of property owners whose property is
126 damaged as a result of a pursuit involving a federal law enforcement
137 agency.
148 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
159 SECTION 1. Section 683.015(f), Transportation Code, is
1610 amended to read as follows:
1711 (f) A law enforcement agency or an attorney representing the
1812 state may use funds transferred under Subsection (d) to compensate
1913 property owners whose property was damaged as a result of a pursuit
2014 involving a law enforcement agency or a federal law enforcement
2115 agency, regardless of whether the agency would be liable under
2216 Chapter 101, Civil Practice and Remedies Code.
2317 SECTION 2. The change in law made by this Act applies only
2418 to property damage occurring on or after the effective date of this
2519 Act. Property damage occurring before the effective date of this
2620 Act is governed by the law in effect at the time the damage
2721 occurred, and the former law is continued in effect for that
2822 purpose.
2923 SECTION 3. This Act takes effect immediately if it receives
3024 a vote of two-thirds of all the members elected to each house, as
3125 provided by Section 39, Article III, Texas Constitution. If this
3226 Act does not receive the vote necessary for immediate effect, this
3327 Act takes effect September 1, 2015.
