13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 8 | | SECTION 1. Section 379C.004(a), Local Government Code, is |
---|
15 | 9 | | amended to read as follows: |
---|
16 | 10 | | (a) The governing body of a municipality may adopt an urban |
---|
17 | 11 | | land bank demonstration program in which the officer charged with |
---|
18 | 12 | | selling real property ordered sold pursuant to foreclosure of a tax |
---|
19 | 13 | | lien may sell certain eligible real property by private sale for |
---|
20 | 14 | | [purposes of] affordable housing development or other purposes as |
---|
21 | 15 | | provided by this chapter. |
---|
22 | 16 | | SECTION 2. Sections 379C.014(a) and (c), Local Government |
---|
23 | 17 | | Code, as added by Chapter 1037 (H.B. 2840), Acts of the 83rd |
---|
24 | 18 | | Legislature, Regular Session, 2013, are amended to read as follows: |
---|
25 | 19 | | (a) Notwithstanding the other provisions of this chapter, |
---|
26 | 20 | | the land bank may acquire and sell to a developer property intended |
---|
27 | 21 | | for commercial use [to a developer to allow the construction of a |
---|
28 | 22 | | grocery store that has at least 6,000 square feet of enclosed space |
---|
29 | 23 | | and that offers for sale fresh produce and other food items for home |
---|
30 | 24 | | consumption]. |
---|
31 | 25 | | (c) A sale under this section within the four-year period |
---|
32 | 26 | | following the date of acquisition of the property by the land bank |
---|
33 | 27 | | is for a public purpose and satisfies the requirement under Section |
---|
34 | 28 | | 379C.009(b) that the property be sold within the four-year [that] |
---|
35 | 29 | | period to a qualified participating developer. |
---|
36 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 31 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 33 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 34 | | Act takes effect September 1, 2015. |
