115 relating to the acquisition and sale of unimproved real property by
126 an urban land bank.
137 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
148 SECTION 1. Section 379C.004(a), Local Government Code, is
159 amended to read as follows:
1610 (a) The governing body of a municipality may adopt an urban
1711 land bank demonstration program in which the officer charged with
1812 selling real property ordered sold pursuant to foreclosure of a tax
1913 lien may sell certain eligible real property by private sale for
2014 [purposes of] affordable housing development or other purposes as
2115 provided by this chapter.
2216 SECTION 2. Sections 379C.014(a) and (c), Local Government
2317 Code, as added by Chapter 1037 (H.B. 2840), Acts of the 83rd
2418 Legislature, Regular Session, 2013, are amended to read as follows:
2519 (a) Notwithstanding the other provisions of this chapter,
2620 the land bank may acquire and sell to a developer property intended
2721 for commercial use [to a developer to allow the construction of a
2822 grocery store that has at least 6,000 square feet of enclosed space
2923 and that offers for sale fresh produce and other food items for home
3024 consumption].
3125 (c) A sale under this section within the four-year period
3226 following the date of acquisition of the property by the land bank
3327 is for a public purpose and satisfies the requirement under Section
3428 379C.009(b) that the property be sold within the four-year [that]
3529 period to a qualified participating developer.
3630 SECTION 3. This Act takes effect immediately if it receives
3731 a vote of two-thirds of all the members elected to each house, as
3832 provided by Section 39, Article III, Texas Constitution. If this
3933 Act does not receive the vote necessary for immediate effect, this
4034 Act takes effect September 1, 2015.
