10- AN ACT
114 relating to the creation of the Cotton Center Municipal Utility
125 District No. 1; granting a limited power of eminent domain;
136 providing authority to issue bonds; providing authority to impose
147 assessments, fees, and taxes.
158 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
169 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1710 Code, is amended by adding Chapter 8492 to read as follows:
1811 CHAPTER 8492. COTTON CENTER MUNICIPAL UTILITY DISTRICT NO. 1
1912 SUBCHAPTER A. GENERAL PROVISIONS
2013 Sec. 8492.001. DEFINITIONS. In this chapter:
2114 (1) "Board" means the district's board of directors.
2215 (2) "Commission" means the Texas Commission on
2316 Environmental Quality.
2417 (3) "Director" means a board member.
2518 (4) "District" means the Cotton Center Municipal
2619 Utility District No. 1.
2720 Sec. 8492.002. NATURE OF DISTRICT. The district is a
2821 municipal utility district created under Section 59, Article XVI,
2922 Texas Constitution.
3023 Sec. 8492.003. CONFIRMATION AND DIRECTORS' ELECTION
3124 REQUIRED. The temporary directors shall hold an election to
3225 confirm the creation of the district and to elect five permanent
3326 directors as provided by Section 49.102, Water Code.
3427 Sec. 8492.004. CONSENT OF MUNICIPALITY REQUIRED. The
3528 temporary directors may not hold an election under Section 8492.003
3629 until each municipality in whose corporate limits or
3730 extraterritorial jurisdiction the district is located has
3831 consented by ordinance or resolution to the creation of the
3932 district and to the inclusion of land in the district.
4033 Sec. 8492.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4134 The district is created to serve a public purpose and benefit.
4235 (b) The district is created to accomplish the purposes of:
4336 (1) a municipal utility district as provided by
4437 general law and Section 59, Article XVI, Texas Constitution; and
4538 (2) Section 52, Article III, Texas Constitution, that
4639 relate to the construction, acquisition, improvement, operation,
4740 or maintenance of macadamized, graveled, or paved roads, or
4841 improvements, including storm drainage, in aid of those roads.
4942 Sec. 8492.006. INITIAL DISTRICT TERRITORY. (a) The
5043 district is initially composed of the territory described by
5144 Section 2 of the Act enacting this chapter.
5245 (b) The boundaries and field notes contained in Section 2 of
5346 the Act enacting this chapter form a closure. A mistake made in the
5447 field notes or in copying the field notes in the legislative process
5548 does not affect the district's:
5649 (1) organization, existence, or validity;
5750 (2) right to issue any type of bond for the purposes
5851 for which the district is created or to pay the principal of and
5952 interest on a bond;
6053 (3) right to impose a tax; or
6154 (4) legality or operation.
6255 SUBCHAPTER B. BOARD OF DIRECTORS
6356 Sec. 8492.051. GOVERNING BODY; TERMS. (a) The district is
6457 governed by a board of five elected directors.
6558 (b) Except as provided by Section 8492.052, directors serve
6659 staggered four-year terms.
6760 Sec. 8492.052. TEMPORARY DIRECTORS. (a) The temporary
6861 board consists of:
6962 (1) Angela Fulcher;
7063 (2) Julie Dolby Casner;
7164 (3) Laurie Gosda;
7265 (4) Sandra Wood; and
7366 (5) Cheri D. Hisaw.
7467 (b) Temporary directors serve until the earlier of:
7568 (1) the date permanent directors are elected under
7669 Section 8492.003; or
7770 (2) the fourth anniversary of the effective date of
7871 the Act enacting this chapter.
7972 (c) If permanent directors have not been elected under
8073 Section 8492.003 and the terms of the temporary directors have
8174 expired, successor temporary directors shall be appointed or
8275 reappointed as provided by Subsection (d) to serve terms that
8376 expire on the earlier of:
8477 (1) the date permanent directors are elected under
8578 Section 8492.003; or
8679 (2) the fourth anniversary of the date of the
8780 appointment or reappointment.
8881 (d) If Subsection (c) applies, the owner or owners of a
8982 majority of the assessed value of the real property in the district
9083 may submit a petition to the commission requesting that the
9184 commission appoint as successor temporary directors the five
9285 persons named in the petition. The commission shall appoint as
9386 successor temporary directors the five persons named in the
9487 petition.
9588 SUBCHAPTER C. POWERS AND DUTIES
9689 Sec. 8492.101. GENERAL POWERS AND DUTIES. The district has
9790 the powers and duties necessary to accomplish the purposes for
9891 which the district is created.
9992 Sec. 8492.102. MUNICIPAL UTILITY DISTRICT POWERS AND
10093 DUTIES. The district has the powers and duties provided by the
10194 general law of this state, including Chapters 49 and 54, Water Code,
10295 applicable to municipal utility districts created under Section 59,
10396 Article XVI, Texas Constitution.
10497 Sec. 8492.103. AUTHORITY FOR ROAD PROJECTS. Under Section
10598 52, Article III, Texas Constitution, the district may design,
10699 acquire, construct, finance, issue bonds for, improve, operate,
107100 maintain, and convey to this state, a county, or a municipality for
108101 operation and maintenance macadamized, graveled, or paved roads, or
109102 improvements, including storm drainage, in aid of those roads.
110103 Sec. 8492.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
111104 project must meet all applicable construction standards, zoning and
112105 subdivision requirements, and regulations of each municipality in
113106 whose corporate limits or extraterritorial jurisdiction the road
114107 project is located.
115108 (b) If a road project is not located in the corporate limits
116109 or extraterritorial jurisdiction of a municipality, the road
117110 project must meet all applicable construction standards, zoning and
118111 subdivision requirements, and regulations of each county in which
119112 the road project is located.
120113 (c) If the state will maintain and operate the road, the
121114 Texas Transportation Commission must approve the plans and
122115 specifications of the road project.
123116 Sec. 8492.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
124117 OR RESOLUTION. The district shall comply with all applicable
125118 requirements of any ordinance or resolution that is adopted under
126119 Section 54.016 or 54.0165, Water Code, and that consents to the
127120 creation of the district or to the inclusion of land in the
128121 district.
129122 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
130123 Sec. 8492.151. DIVISION OF DISTRICT; PREREQUISITES. The
131124 district may be divided into two or more new districts only if the
132125 district:
133126 (1) has never issued any bonds; and
134127 (2) is not imposing ad valorem taxes.
135128 Sec. 8492.152. LAW APPLICABLE TO NEW DISTRICT. This
136129 chapter applies to any new district created by division of the
137130 district, and a new district has all the powers and duties of the
138131 district.
139132 Sec. 8492.153. LIMITATION ON AREA OF NEW DISTRICT. A new
140133 district created by the division of the district may not, at the
141134 time the new district is created, contain any land outside the area
142135 described by Section 2 of the Act enacting this chapter.
143136 Sec. 8492.154. DIVISION PROCEDURES. (a) The board, on its
144137 own motion or on receipt of a petition signed by the owner or owners
145138 of a majority of the assessed value of the real property in the
146139 district, may adopt an order dividing the district.
147140 (b) The board may adopt an order dividing the district
148141 before or after the date the board holds an election under Section
149142 8492.003 to confirm the district's creation.
150143 (c) An order dividing the district must:
151144 (1) name each new district;
152145 (2) include the metes and bounds description of the
153146 territory of each new district;
154147 (3) appoint temporary directors for each new district;
155148 and
156149 (4) provide for the division of assets and liabilities
157150 between the new districts.
158151 (d) On or before the 30th day after the date of adoption of
159152 an order dividing the district, the district shall file the order
160153 with the commission and record the order in the real property
161154 records of each county in which the district is located.
162155 Sec. 8492.155. CONFIRMATION ELECTION FOR NEW DISTRICT. (a)
163156 A new district created by the division of the district shall hold a
164157 confirmation and directors' election as required by Section
165158 8492.003.
166159 (b) If the creation of the new district is confirmed, the
167160 new district shall provide the election date and results to the
168161 commission.
169162 Sec. 8492.156. TAX OR BOND ELECTION. Before a new district
170163 created by the division of the district may impose a maintenance tax
171164 or issue bonds payable wholly or partly from ad valorem taxes, the
172165 new district must hold an election as required by this chapter to
173166 obtain voter approval.
174167 Sec. 8492.157. MUNICIPAL CONSENT. Municipal consent to the
175168 creation of the district and to the inclusion of land in the
176169 district granted under Section 8492.004 acts as municipal consent
177170 to the creation of any new district created by the division of the
178171 district and to the inclusion of land in the new district.
179172 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
180173 Sec. 8492.201. ELECTIONS REGARDING TAXES OR BONDS. (a) The
181174 district may issue, without an election, bonds and other
182175 obligations secured by:
183176 (1) revenue other than ad valorem taxes; or
184177 (2) contract payments described by Section 8492.203.
185178 (b) The district must hold an election in the manner
186179 provided by Chapters 49 and 54, Water Code, to obtain voter approval
187180 before the district may impose an ad valorem tax or issue bonds
188181 payable from ad valorem taxes.
189182 (c) The district may not issue bonds payable from ad valorem
190183 taxes to finance a road project unless the issuance is approved by a
191184 vote of a two-thirds majority of the district voters voting at an
192185 election held for that purpose.
193186 Sec. 8492.202. OPERATION AND MAINTENANCE TAX. (a) If
194187 authorized at an election held under Section 8492.201, the district
195188 may impose an operation and maintenance tax on taxable property in
196189 the district in accordance with Section 49.107, Water Code.
197190 (b) The board shall determine the tax rate. The rate may not
198191 exceed the rate approved at the election.
199192 Sec. 8492.203. CONTRACT TAXES. (a) In accordance with
200193 Section 49.108, Water Code, the district may impose a tax other than
201194 an operation and maintenance tax and use the revenue derived from
202195 the tax to make payments under a contract after the provisions of
203196 the contract have been approved by a majority of the district voters
204197 voting at an election held for that purpose.
205198 (b) A contract approved by the district voters may contain a
206199 provision stating that the contract may be modified or amended by
207200 the board without further voter approval.
208201 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
209202 Sec. 8492.251. AUTHORITY TO ISSUE BONDS AND OTHER
210203 OBLIGATIONS. The district may issue bonds or other obligations
211204 payable wholly or partly from ad valorem taxes, impact fees,
212205 revenue, contract payments, grants, or other district money, or any
213206 combination of those sources, to pay for any authorized district
214207 purpose.
215208 Sec. 8492.252. TAXES FOR BONDS. At the time the district
216209 issues bonds payable wholly or partly from ad valorem taxes, the
217210 board shall provide for the annual imposition of a continuing
218211 direct ad valorem tax, without limit as to rate or amount, while all
219212 or part of the bonds are outstanding as required and in the manner
220213 provided by Sections 54.601 and 54.602, Water Code.
221214 Sec. 8492.253. BONDS FOR ROAD PROJECTS. At the time of
222215 issuance, the total principal amount of bonds or other obligations
223216 issued or incurred to finance road projects and payable from ad
224217 valorem taxes may not exceed one-fourth of the assessed value of the
225218 real property in the district.

901894 SECTION 3. (a) The legal notice of the intention to
902895 introduce this Act, setting forth the general substance of this
903896 Act, has been published as provided by law, and the notice and a

905898 officials, or entities to which they are required to be furnished
906899 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
907900 Government Code.
908901 (b) The governor, one of the required recipients, has
909902 submitted the notice and Act to the Texas Commission on
910903 Environmental Quality.
911904 (c) The Texas Commission on Environmental Quality has filed
912905 its recommendations relating to this Act with the governor, the
913906 lieutenant governor, and the speaker of the house of
914907 representatives within the required time.
915908 (d) All requirements of the constitution and laws of this
916909 state and the rules and procedures of the legislature with respect
917910 to the notice, introduction, and passage of this Act are fulfilled
918911 and accomplished.
919912 SECTION 4. (a) If this Act does not receive a two-thirds
920913 vote of all the members elected to each house, Subchapter C, Chapter
921914 8492, Special District Local Laws Code, as added by Section 1 of
922915 this Act, is amended by adding Section 8492.106 to read as follows:
923916 Sec. 8492.106. NO EMINENT DOMAIN POWER. The district may
924917 not exercise the power of eminent domain.
925918 (b) This section is not intended to be an expression of a
926919 legislative interpretation of the requirements of Section 17(c),
927920 Article I, Texas Constitution.
928921 SECTION 5. This Act takes effect immediately if it receives
929922 a vote of two-thirds of all the members elected to each house, as
930923 provided by Section 39, Article III, Texas Constitution. If this
931924 Act does not receive the vote necessary for immediate effect, this
932925 Act takes effect September 1, 2015.
