55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the creation of a committee to evaluate special
88 education services in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 29, Education Code, is
1111 amended by adding Section 29.022 to read as follows:
1212 Sec. 29.022. SPECIAL EDUCATION SERVICES EVALUATION
1313 COMMITTEE. (a) A committee is established under this section to
1414 examine, review, and evaluate the provision of special education
1515 services by public school districts in the state.
1616 (b) The commissioner, in collaboration with the lieutenant
1717 governor and the speaker of the house of representatives, shall
1818 appoint members of the committee. The committee shall be composed
1919 of:
2020 (1) one member of the house of representatives;
2121 (2) one member of the senate;
2222 (3) one superintendent of a school district;
2323 (4) one special education teacher;
2424 (5) three parents of students who receive special
2525 education services from a school district;
2626 (6) one physician who is a doctor of medicine; and
2727 (7) one attorney who specializes in education law.
2828 (c) The commissioner, in collaboration with the lieutenant
2929 governor and the speaker of the house of representatives, shall
3030 designate a member of the committee to serve as presiding officer.
3131 (d) The commissioner, in collaboration with the lieutenant
3232 governor and the speaker of the house of representatives, shall
3333 appoint the members of the committee not later than November 1,
3434 2015.
3535 (e) The presiding officer shall call the initial meeting of
3636 the committee on or before December 1, 2015. The committee shall
3737 meet at the times and places that the presiding officer determines
3838 are appropriate. The committee shall adopt rules necessary to
3939 fulfill the committee's duties under this section.
4040 (f) Members of the committee serve without compensation.
4141 (g) Chapter 2110, Government Code, does not apply to the
4242 committee.
4343 (h) The committee shall:
4444 (1) evaluate the compliance of each public school
4545 district with current laws and rules related to special education
4646 services; and
4747 (2) review current laws and rules related to special
4848 education services in public schools and recommend changes or
4949 improvements to the laws or rules.
5050 (i) Not later than November 1, 2016, the committee shall
5151 deliver a report to the governor, lieutenant governor, speaker of
5252 the house of representatives, and appropriate committees of the
5353 legislature that includes:
5454 (1) a description of the activities of the committee;
5555 (2) the findings and recommendations of the committee,
5656 including any proposed policy and research recommendations; and
5757 (3) any proposals for legislation or other matters the
5858 committee considers appropriate.
5959 (j) The committee is abolished and this section expires
6060 December 1, 2016.
6161 SECTION 2. This Act takes effect immediately if it receives
6262 a vote of two-thirds of all the members elected to each house, as
6363 provided by Section 39, Article III, Texas Constitution. If this
6464 Act does not receive the vote necessary for immediate effect, this
6565 Act takes effect September 1, 2015.
