7 | 7 | | relating to certain dedicated accounts in the general revenue fund |
---|
8 | 8 | | that fund trauma facilities and emergency medical services. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 542.406(c), Transportation Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (c) Not later than the 60th day after the end of a local |
---|
13 | 13 | | authority's fiscal year, after deducting amounts the local |
---|
14 | 14 | | authority is authorized by Subsection (d) to retain, the local |
---|
15 | 15 | | authority shall: |
---|
16 | 16 | | (1) send 50 percent of the revenue derived from civil |
---|
17 | 17 | | or administrative penalties collected by the local authority under |
---|
18 | 18 | | this section to the comptroller for deposit to the credit of the |
---|
19 | 19 | | designated [regional] trauma facility and emergency medical |
---|
20 | 20 | | services account established under Section 780.003 [782.002], |
---|
21 | 21 | | Health and Safety Code; and |
---|
22 | 22 | | (2) deposit the remainder of the revenue in a special |
---|
23 | 23 | | account in the local authority's treasury that may be used only to |
---|
24 | 24 | | fund traffic safety programs, including pedestrian safety |
---|
25 | 25 | | programs, public safety programs, intersection improvements, and |
---|
26 | 26 | | traffic enforcement. |
---|
27 | 27 | | SECTION 2. Section 707.008(a), Transportation Code, is |
---|
28 | 28 | | amended to read as follows: |
---|
29 | 29 | | (a) Not later than the 60th day after the end of a local |

46 | 46 | | Sec. 780.002. CERTAIN DEPOSITS TO ACCOUNT. |

47 | 47 | | SECTION 4. Section 780.003(b), Health and Safety Code, is |
---|
48 | 48 | | amended to read as follows: |
---|
49 | 49 | | (b) The account is composed of money deposited to the credit |
---|
50 | 50 | | of the account under Sections 542.406 and 707.008, Transportation |
---|
51 | 51 | | Code, and under Section 780.002 of this code[, and the earnings of |
---|
52 | 52 | | the account]. |
---|
53 | 53 | | SECTION 5. The following laws are repealed: |
---|
54 | 54 | | (1) Section 780.003(c), Health and Safety Code; and |
---|
55 | 55 | | (2) Chapter 782, Health and Safety Code. |
---|
56 | 56 | | SECTION 6. On the effective date of this Act: |
---|
57 | 57 | | (1) the regional trauma account established under |
---|
58 | 58 | | Chapter 782, Health and Safety Code, is abolished; and |
---|
59 | 59 | | (2) any unexpended and unobligated balance of money in |
---|
60 | 60 | | the regional trauma account is transferred to the designated trauma |
---|
61 | 61 | | facility and emergency medical services account established under |
---|
62 | 62 | | Section 780.003, Health and Safety Code. |
---|
63 | 63 | | SECTION 7. This Act takes effect September 1, 2015. |
