55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to certain dedicated accounts in the general revenue fund
88 that fund trauma facilities and emergency medical services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 542.406(c), Transportation Code, is
1111 amended to read as follows:
1212 (c) Not later than the 60th day after the end of a local
1313 authority's fiscal year, after deducting amounts the local
1414 authority is authorized by Subsection (d) to retain, the local
1515 authority shall:
1616 (1) send 50 percent of the revenue derived from civil
1717 or administrative penalties collected by the local authority under
1818 this section to the comptroller for deposit to the credit of the
1919 designated [regional] trauma facility and emergency medical
2020 services account established under Section 780.003 [782.002],
2121 Health and Safety Code; and
2222 (2) deposit the remainder of the revenue in a special
2323 account in the local authority's treasury that may be used only to
2424 fund traffic safety programs, including pedestrian safety
2525 programs, public safety programs, intersection improvements, and
2626 traffic enforcement.
2727 SECTION 2. Section 707.008(a), Transportation Code, is
2828 amended to read as follows:
2929 (a) Not later than the 60th day after the end of a local
3030 authority's fiscal year, after deducting amounts the local
3131 authority is authorized by Subsection (b) to retain, the local
3232 authority shall:
3333 (1) send 50 percent of the revenue derived from civil
3434 or administrative penalties collected by the local authority under
3535 this section to the comptroller for deposit to the credit of the
3636 designated [regional] trauma facility and emergency medical
3737 services account established under Section 780.003 [782.002],
3838 Health and Safety Code; and
3939 (2) deposit the remainder of the revenue in a special
4040 account in the local authority's treasury that may be used only to
4141 fund traffic safety programs, including pedestrian safety
4242 programs, public safety programs, intersection improvements, and
4343 traffic enforcement.
4444 SECTION 3. The heading to Section 780.002, Health and
4545 Safety Code, is amended to read as follows:
4646 Sec. 780.002. CERTAIN DEPOSITS TO ACCOUNT.
4747 SECTION 4. Section 780.003(b), Health and Safety Code, is
4848 amended to read as follows:
4949 (b) The account is composed of money deposited to the credit
5050 of the account under Sections 542.406 and 707.008, Transportation
5151 Code, and under Section 780.002 of this code[, and the earnings of
5252 the account].
5353 SECTION 5. The following laws are repealed:
5454 (1) Section 780.003(c), Health and Safety Code; and
5555 (2) Chapter 782, Health and Safety Code.
5656 SECTION 6. On the effective date of this Act:
5757 (1) the regional trauma account established under
5858 Chapter 782, Health and Safety Code, is abolished; and
5959 (2) any unexpended and unobligated balance of money in
6060 the regional trauma account is transferred to the designated trauma
6161 facility and emergency medical services account established under
6262 Section 780.003, Health and Safety Code.
6363 SECTION 7. This Act takes effect September 1, 2015.
